1976-220RESOLUTION NO. 76R-22.0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2779. WHEREAS, after a request t for variance by ANAHEIM HILLS, INC., owner, the BALDWIN COMPANY, agent, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 27.79 was granted, -covering the following described property. Those portions of Section 7 in Township 4 South, Range 8 West and of Section 12 in Township 4 South, Range 9 West, in the Rancho Santiago de Santa Ana in the City of Anaheim, County of Orange,.State of California, being also a portion of the Paula Peralta de Dominguez allotment described in the final decree of partition of said Rancho, which was entered September 12, 1868, in Book "B" at Page 410 of Judgments of the District Court of the 17th Judicial District in and for Los Angeles County, California, described as follows: Beginning at the most Northeasterly corner of the land described as Parcel 2 in the Deed to the City of Anaheim recorded March 15, 1973, in Book 10596 at Page 441 et seq., of Official Records, records of said Orange County; thence following the lines of said Parcel 2, South 211 26' 3811 Fest, 197.94 feet and South 030 261 03" East, 250.45 feet and South 360 05' 051' East, 365.03 feet and South 700 141 3211 East 260.33 feet and South 091 461 13f1 West, 306.44 feet; thence leaving the dines of said Parcel 2 and running South 190 311 1811 West, 233.42 feet; thence South 770 451 3411 West, 254.33 feet; thence South 22.0 101 1011 East, 579.61 feet; thence South 710 06.1 0011 West, 178.18 feet to a tangent curve concave Northwesterly and.having a radius of 400.00 feet; thence Westerly along said curve through a central angle of 250 35' 0011 an arc distance of 178.61 feet; thence 'North 830 191 00" West, 144.38 feet; thence South 150 301 0011 East, 440.29 feet; thence South 560 301 00'1 East, 408.00 feet; thence on a bearing of East a distance of 260.00 feet; thence North 560 481 Q0.11 East, 692.00 feet; thence on a bearing of ?North 23.5.00 feet;.thence on a bearing of East 136.00 feet;.thence North 190 581 0011 East, 249.00 feet; thence on a bearing of East 305.00 feet; thence North 620 101 1711 East, 271.85 feet to the center- line of Nohl Ranch Road as shown on a map of Tract No. 8104 recorded in Book 320. Pages 20 through 24 inclusive of Miscellaneous Maps, records of said County; thence along said centerline Forth 040 081 58" West, 265.00 feet to a tangent curve concave Easterly and having a radius of 1000.00 feet; thence Northerly along said curve through a central angle of 130 001 4911 an are distance of 22.7.13 feet; thence tangent North 080 51' 51" East, 470.24 feet to a tangent curve concave Southwesterly and having a radius of 600.00 feet; thence Northerly and Westerly along said curve through a central angle of 112° 071 4511 an are distance of 1174.21 feet; thence tangent South 761 441 06f1 West, 53.00 feet to a tangent curve concave Northerly and having a radius of 1344.00 feet; thence Westerly along said curve through a central angle of 07° 531 28t1 an arc distance of 135.10 feet; thence tangent South 84° 371 34" West, 372.57 feet to a point herein after referred to as point "A"; thence continuing along said centerline, South 84° 371 3411 West, 13.86 feet to a tangent curve concave Northerly and having a radius of 821.00 feet; thence Westerly along said curve through a central angle of 261 491 0411 an are distance of 384.28 feet; thence North 68° 331 22" West, 160.55 feet to the point of beginning. Excepting therefrom a 4.000 acre parcel of land described as follows: Beginning at point "A11 described above; thence South 050 221 1611 East, 335.00 feet; thence South 840 371 34" West, 406.86 feet•, thence North 220 221 1811 West, 347.81 feet; thence North 210 261 3811 East, 137.00 feet to the centerline of said Nohl Ranch Road; thence along said centerline, South 680 331 2211 East, 70.00 feet to a tangent curve concave Northerly and having a radius of 821.00 feet; thence Easterly along said curve through a central angle of 261 491 04t1 an are distance of 384.28 feet; thence North 840 371 3411 East 13.86 feet to the point of beginning. Reserving unto the grantor herein, with the mutual agreement of the City of Anaheim, the right to modify the boundaries of the excepted 4.000. acre parcel described above. Subject to covenants, conditions, reservations, restrictions, rights, rights of way and easement, if any, of record. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following .findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted, permitting the construc- tion of a 214 -lot., 210 -unit single-family tract on the property hereinbefore described with waivers of the 'following sections of the Anaheim Municipal Code: SECTION 18.27.061.020 Minimum lot width. (45 feet required; 1155 feet proposed) SECTION 18.27-065.01,0 - Requirement that single- family lots rear -on arterial highways. That said variance be granted subject to the following conditions: 1. That this Variance is granted subject to the completion of Reclassification No. 75-76-22, now pending. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 23 3, 4 and 5. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise sPeci- fied herein.
