1976-216RESOLUTION NO. 76PR-216 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING TnAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Declassification Pro- ceedings No. 75-76-2 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 27th day of April, , 19 76, and continued to the day of 19 , as the time, and the City Councli=Nambers in__t_hCity Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED the City of Anaheim that Title 18 of the be, and the same is hereby, amended and described property, situated in the City Orange, State of California, to wit: ATTY-18-C (Page 1 of 1 page) by the City Council of Anaheim Municipal Code that the following of Anaheim, County of 75-76-2 That portion of allotment in decree of Partition of the Rancho Canon de Santa Ana, recorded in Case No. 1978, of the 17th judicial District Court of Califor- nia, a certified copy of which was recorded February 8, 1874, in Book 28, Page 153 of Deed, in the office of the County Recorder of Los Angeles County, Cali- fornia, in the City of Anaheim, County of Orange, California, described as follows: Parcel 1 as shown on a map recorded in Book 30, Pages 48 and 49 of Parcel Maps excepting therefrom the following described property. Beginning at the Northeasterly corner of the land described in the deed to the State of California re- corded October 30th, 1956 in book 3893, Page 374 of Official Records of said county and state; thence along the Easterly and Southerly line of said land the following courses; South 50 331 18" West 324.54 feet; thence North 88* 361 11" West 14.92 feet to a point on the Easterly line of the land described in. a deed to the State of California, recorded October 14th, 1952 in Book 2395, Page 522 of Official Records of said county and state; thence along said Easterly line South 10 231 00" West 47.64 fee -IC,, thence South 880 371 00" East 857.17 feet to the North line of said parcel 1. thence North 1* 231 00" East along said North line 412.10 feet to the Southerly line of a strip of land, 100.00 feet wide, as conveyed to the Riverside, Santa Ana and Los Angeles Railway Company, by deed recorded July 7, 11886, 886, in Book 164, Page 508 of Deeds, Records of Los Angeles County California,, said 100.00 feet nide I - strip being now vested in the Atcheson Topeka and Santa Fe Rai`wa� L y Co. a corporation, which point is a point on the curve of said Southerly line, concave Northerly having a radius of 5779.65 feet, a radial bearing to said point bears South 10 471 02" East, thence Westerly along said curve through a central angle of 0® 191 0211 an arc length of 32.00 feet; thence South 8" 321 00" West 787.18 feet to the point of beginning. be excluded from "RM-1203(SC)" RES !DENT IAI.I, ZONE and incorporated in "CL (SC)" CODRDIIERCIA'.r., LIMITED ZONE subject to the following conditions: 1. That all engineering requirements of the City of Anaheim, along Imperial Highway, La Palma avenue, and Street "Pa." including preparation of improvement plans and installation of all improve- ments such as curbs, gutters, sidewalks, street grading aril paving, drainage facilities or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with stand- ard plans and specifications on file in the Office of the City Engineer; that street lighting facilities along Imperial highway, La Palma Avenue and Street "A" shall be installed as required by the Director of Public Utilities and in accordance with standard Plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfac- tory to the City of Anaheim shall be post -ed with the City to guarantee the installation of the above-mentioned reauirements. 2. That the owner (s) of subject property shall pay to the City of Anaheim the sum of sixty cents per front foot along Street "A" for tree planting purposes. 3. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 4. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior -to cormencement of structural framing. 5. That subject property shall be served by underground utilities. 6. That drainage of subject Property shall be disposed of in a manner satisfactory to the City Engineer. 7. In the event that subject property is to be divided for the Purpose of sale, lease or financing, a Parcel map to record the approved division of subject Property shall be submitted to and approved by Cie City of Anaheim and then be recorded in the Office of the Orange County Recorder. 8. That completion of these reclassification proceedings is contingent upon the granting of Variance No. 2733. 9. That appropriate water assessment- fees, as determined by the Director of Public Utilities, shall be paid to the City of Anaheim prior to the issuance of a building permit. 10. Prior to the introduction of an ordinance rezoning sub- ject property, Condition Nos. 1, 2 and 7, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one (l) year from the date hereof, or such further tine as the City Council may grant. 11. That Condition Nos. 3. 5 and 6, above—mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 180'of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
