RESOLUT ION NO. 76R-_199
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
IENT
OF ANAHEIM APPROVING THE TERMS OF AN A,GREEE
BETWTEN THE CITY OF ANAHEIM AND SUNDIAL -PCB
COMPANY RE REIMBURSEZENT OF COSTS FOR SPECIAL
WIATER FACILITIES, AND AUTHORI.ZING THE M&YOR
AND CITY CL2RK TO EXECUTE SAID AGMEIWIENT.
WHEREAS, Sundial -PCB Company has applied to the City
for water facilities to serve Tract -9133; and
WHEREAS, the City is unable to furnish water to said
Tract in the absence of special facilities as defined pursuant
to Rule No. 15 of'the TNTater Rules of the City of Anaheim; and
WHER]EAS, Sundial -PCB Company is willing to pay the
City its share of prior advances pursuant to said Rule No. 3_5
and the City is willing to attempt to collect from the ultimate
users of said special facilities, and/or persons within the
Special Facility's District No. 1, the fees necessary to reim-
burse Sundial -PCB Company towards the cost of said special
facilities; and
WHEREAS, an agreement has been prepared, the terms and
conditions of which are satisfactory to and in the best interests
of the City of Anaheim.
NOW, THEREFOREI BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of an agree-
ment between the City of Anaheim and Sundial -PCB Company in con-
nection with the reimbursement of costs for special water facil-
ities be, and the same are hereby, approved.
IT FURTHER RESOLVED that the Mayor and CitY Clerk
are hereby authorized to execute said agreement on behalf of the
City of Anaheim.
THE FOREGOING RE -SOLUTION is approved and signed by me
