1976-662• RESOLUTION NO. 76R-__QL2* A RESOLUTION OF THE CITY COUivCIL OF THE CITY OF ANAHEIM APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT FOR THE CANCELLATION OF THE AGRICULTURAL PRESERVE AGREEMENT IN CONNECTION WITH PROPERTY OWNED BY RAYMOND G. SII2PSON AND SUSAN L. GUILES, TRUSTEES OF THE SIMPSON FAMILY TRUST, WITH REQUEST FOR WAIVER OF FEES AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID AGREEMENT ON BEHALF OF THE CITY OF ANAHEIM. WHEREAS, Raymond G. Simpson and Susan L. Guiles, Trustees of the Simpson Family Trust, are -'fee simple owners of approximately 11.5 acres of real property in the County of Orange; and WHEREAS, Raymond G. Simpson and Susan L. Guiles and the County of Orange entered into an Agreement commonly known as the Douglass -Sunkist Agricultural Preserve Agreement which is referred to as "Preserve Agreement" on February 26, 1969, pursuant to the California Land Conservation Act of 1965, set forth in the Califor- nia Government Code commencing with Section 51200; and WHEREAS, pursuant to Paragraph 10 of the Preserve Agree- ment and Sections 51281 through 51285 of the Government Code, Raymond G. Simpson and Susan L. Guiles petitioned the City of Anaheim for cancellation of the Preserve Agreement having hereto- fore been annexed to the City of Anaheim; said annexation becoming effective the 26th day of October, 1976; and WHEREAS, having duly considered Raymond G. Simpson and Susan L. Guiles' petition and having complied with all of the pro- cedures required by law, the City determined, partially in consi- deration of Raymond G. Simpson and Susan L. Guiles' covenants. set forth in said Agreement, that cancellation of the Preserve Agree- ment is not inconsistent with the purposes of the California Land Conservation Act of 1965 and that cancellation of the Preserve Agreement is in the public interest; and WHEREAS, Raymond G. Simpson and Susan L. Guiles' coven- ants set forth in said Agreement are in consideration of the.City of Anaheim's consent to the cancellation of the Preserve Agreement; and WHEREAS, the City Council of the City of Anaheim agrees to include a provision concerning refund of $10,000.00 in fees paid. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the terms and conditions of an Agreement for the cancellation of the Agricultural Preserve Agreement in connection with property owned by Raymond G. Simpson and Susan L. Guiles, Trustees of the Simpson Family Trust, along with a request for waiver of fees, be, and they are hereby, approved. BE Irl' FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby, authorized to execute said Agreement on behalf of the City of Anaheim.
