RESOLUTION NO. 76R-652
• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ORDERING THE VACATION AND ABANDON-
MENT OF A CERTAIN PUBLIC SERVICE EASEMENT.
(Public Utility Easement 76-6A)
WHEREAS, the City Council of the City of Anaheim has
elected to proceed pursuant to the provisions of the Public
Services Easements Vacation Law (Section 50430 et seq. Government
Code) in connection with the vacation and abandonment of public
service easements; and
WHEREAS, the City Council did, by resolution duly posted
and published, give notice of its intention to abandon the follow-
ing described public service easement (hereinafter "Easement"),
to wit:
That certain easement located in the City of Anaheim,
County of Orange, State of California, for excavation,
grading and construction of a slope area described as
Parcel Two in the deed recorded October 3, 1975 in
Book 11530, pages 428 and 429, Official Records, lying
within that portion of the land described in a deed
recorded in Book 1932, pages 376 and 377, Official
Records, described as follows:
Beginning in a point in the northwest line of the land
described in said deed, said point also being the inter-
section of said northwest line with the westerly right
of way line of Fairmont Boulevard 92.00 feet wide, as
described in a deed recorded in Book 11530, pages 428
and 429, Official Records; thence Southwesterly along
said northwest line 45.00 feet to a point in said
northwest line; thence leaving said northwest line,
southeasterly along a straight line to a point in the
southeast line of said land described in said deed
recorded in Book 1932, pages 376 and 377, Official
Records, said point being distant 107.00 feet south-
westerly measured along said southeast line, from said
westerly right of way line of said Fairmont Boulevard;
thence Northwesterly along said westerly right of way
line of said Fairmont Boulevard to the point of begin-
ning.
RESERVING UNTO the City of Anaheim a right of entry
over said easement for road construction purposes which
right of entry will be terminated upon recordation by
the City of Anaheim of the notice of completion of
Fairmont Blvd.
Said easement is further designated Parcel 2 -Slope
Easement on that map designated Exhibit A which is
attached hereto and incorporated by reference herein; and

WHEREAS, on the 26th day of October, 1976, a public hear-
ing was held to allow interested persons to submit evidence concern-
ing said proposed abandonment; and
WHEREAS, the City Council of the City of Anaheim does
find from the evidence submitted to it, that said Easement is un-
necessary for present or prospective public use.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation and abandonment
of said Easement.
AND BE IT FURTHER RESOLVED that the City Clerk be, and
she is hereby, authorized and directed to cause a certified copy
of this Resolution and Order, attested by her under the seal of
the City of Anaheim to be recorded in the Office of the County Re-
corder of Orange County, California.
