RESOLUTION NO. 73R-16

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF AN~HEIM GR&~TING VARIANCE NO. 2448.
WHEREAS, after a request fpr variance by R. C. JEWETT
AND DIXIE STEPHENS, owners; BOMAINE CORPORATION, agent, was
received, a public hearing before t~ Planning Commission of the
City of Anaheim was held upon due and proper notice as a result
of which Variance No. 2448 was grantad covering the following
described property:
The southerly 150 feet of the nprtherly 210 feet
of the following described prop~rty:
Parcel C, as shown on a map filed in Book 22, Page
32 of Parcel Maps, records of O~ange County.
WHEREAS, thereafter, withip the tune prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Cpmmission action at a public
hearing noticed and held as prescribed by law and as a result
thereof the City Council does hereby make the following findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, Which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. Tha't, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW , THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that a conditional zoning variance be,
and the same is hereby granted permitting the establishment
of a retail car care center on the property hereinbefore
described with waiver of the following Anaheim Municipal Code
section:
SECTION 18.52.020
Permitted uses in the M-l Zone.
That said variance be granted subject to the following conditions:

1. That the sidewalks shall be installed along
Katella Avenue as required by the City Engineer and in accordance
with standard plans and specifications on file in the office of
the City Engineer.
2. That the owner{s) of subject property shall pay
to the City of Anaheim the sum of $2.00 per front foot along
Katella Avenue for street lighting purposes.
3. That aporopriate water assessment fees as
determined by the Dire~tor of Public Utilities shall be paid to
the City of Anaheim prior to the issuance of a building permit.

4. That trash storage areas shall be provided in
accordance with approved plans on fi~e with the office of the
Director of Public Works.
5. That all air conditioning facilities shall be
properly shielded from view.
6. That a parcel map to ~ecord the approved division
of subject property be submitted to and approved by the City of
Anaheim and then be recorded in the office of the Orange County
Recorder.
7. That subject property shall be served by under-
ground utilities.
8. That the final parking plan shall be approved by
the Development Services Department, and any landscaped areas in
the parking area shall be protected ~ith six-inch high concrete
curbs and concrete wheel stops shall be provided for parking
spaces as required by the Developmen~ Services Department.
9. That subject property shall be developed substan-
tially in accordance with plans and specifications on file with
the City of Anaheim marked Exhibit No.1.
10. That Conditions Nos. 2 and 6, above mentioned,
shall be complied with prior to the commencement of the activity
authorized under this resolution or prior to the time that the
building permit is issued, or within a peri~d of one year from
date hereof, whichever occurs first,. or such further time as the
City Council may grant.
11. That Conditions Nos. 1, 4, 5, 7 and 8, above
mentioned, shall be complied with prior to fina~ build!hg and
zoning inspections.
12. That there shall be no outdoor storage of old
tires and used parts as stipulated to by the petitioner.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance penait for good
cause or failure of said owner, his heirs, successors or assigns
to comply with the Anaheim Municipal Code an4 regulations and
tiLe conditions herein. Said variance is granted for the term
prescribed by the Anaheim Municipal Code unless otherwise speci-
fied herein.
