1973-014 -, ,,-., t RESOLUTION NO. 73~-14 A RESOLUTION OF THE CITY COUN(::IL OF THE CITY OF ANAHEIM GRANTING CONDlTIONAL USE PERMIT NO. 1357 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application fori a conditional use permit frOmEDWARD W. BONKOSKY, owner, to est~lish a carwash in conjunction with an automobile servi~e station on the following described property, situat~d in the City of Anaheim, County of Orange, State of Californi~, to wit: The Southerly 190.0 feet as mea~ured at right angles from the South line of t~e West half of the Northwest quarter of the No~thwest quarter of the Northwest quarter of Sec~ion 16, Town- ship 4 South, Range 10 West, as ,shown on a map thereof recorded in Book 51, pa9le 10, Miscel- laneous Maps, records of said O~ange County; said land being further describ~d as the South- erly 190.0 feet, as measured at right angles from the South line of the West half of Lot 4 of Helen and Lynch's Addition tq Anaheim, as shown on a map thereof recorded tin Book 442, page 188, Deeds, records of Los ,Angeles County, California. ~ AND WHEREAS, the City Planning Commission did, hold a public hearing at the City Hall in the-City ot Anaheim upon , said application on . DecAmher ~ , 197? , notices of which said public hearing were daly g~ as required by law and the provisions of Title 18, Chapt.r 18.76 of the .naheim lIInicipal Code; and WHEREAS, said Commission, af~er due inspection, in- vestigation and studies made by itsel~ and in its behalf and after due consideration of all evidenqe and reports offered at said hearing did adopt its Resolution tNo.PC 72-325 ~ deny;nq ConditiQftal Use Permit No. 1357 . , and -1- - ~. WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in nAnyint said conditional use permit and said appeal was set or public hearing on January 16 , 19 73 , at the City Hall, in the City of Anaheim, and notices of such public he4ring were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and pla~e fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interesteq therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council fi~ds, after careful con- sideration of the recommendations of t~e City Planning Commis- sion and all evidence and reports offeted at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the ~rowth and development of the area in which it is ptoposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion in np-nying said conditional use permit be, and the same is hereby disapBroved , and th~t Conditional Use Permit No. 1357 be, an the same is hereby, granted permitting the establishment of a carwash in conjunction with an automo- bile service station on the property hereinbefore described, with waivers of the following described Anaheim Municipal Code provisions: Section 18.40.040 Permitted outdoor uses. (To pe~itoutdoor waxing, polishing and detailing of automobiles. ) ,.....- Section l8.40.020(b) (3) Permitted location of service station limited to the intersection of two arterial highways. ....2- ... ~ ,~....... J""-' That said Conditional Use Permit be ~ranted subject to the following conditions; I, That the owner(s) of subje~t property shall deed to the City of Anaheim a strip of land ~2 feet in width from the centerline of the street along Pampa. Lane for street widening purposes and a 15 foot radiusproper~y line return. 2, That the sidewalks shall b. installed along Euclid Street and Pampas Lane as required by the city Engineer and in acoordance with standard plans and s~ecifications on file in the offioe of the City Engineer. 3. That the vehicular access ~ights, except at approved access points, shall be dedicated to the City of Anaheim. 4. That the owner(s) of subje~t property shall pay to the City of Anaheim the sum of 15 cents Per front foot along Euclid Street and Pampas Lane for tree planting purposes. 5. That trash storage areas shall be provided in aocord- ance with approved plans on file with the offioe of the Director of Public Works. 6. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of $tructural framing. 7. That a six-foot masonry wall shall be constructed along the east property line. 8. That all air-conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent properties. 9. That a parcel map to recor~ the approved division of subject property be submitted to and approved by the City of Anaheim and then be recorded in the ~ffice of the Orange County Recorder. ,~ 10. That subject property shall be served by underground utilities. 11. That any proposed parking area lighting shall be directed away from the adjacent residential parcels. 12. That appropriate water assessment fees as determined by the Director of Public utilities $hall be paid to the City of Anaheim prior to the issuance of a building permit. 13. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4 and 5. 14. That Condition Nos. 1, 3, 4 and 9, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from the date hereof, whichever occurs first or such further time as the planning Commission may grant. -3- "'"'. ............ c 15. That Condition Nos. 2, 5, 7, 8, 10, 12 and 13, above mentioned, shall be complied with pr!or to final building and zoning inspections. The City Council hereby reserve$ the right to revoke such Conditional Use Permit ~or good cause or failure o~ said owners, their heirs, successors or a,signs, to comply with the Anaheim Municipal Code and regulatio,s and conditions herein.
