A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN AGREEMENT WITH SANTA BARBARA, SAVINGS
AND LOAN ASSOCIATION IN CONNECTION ti"JITH REIM-
BURSEMENT OF WATER MAIN EXTENSION FEES 2U1D
AUTHORIZING AND DIRECTING THE .`IAYOR AND CITY
CLERK TO EXECUTE SAID AGREEMENT ON BEHALF OF
THE CITY OF ANAHEIM.
WHEREAS, the City of Anaheim has provided in Rule 15 of
its Water Rates, Rules and Regulations that Primary Distribution
mains which supply water to all areas of the system shall be paid
for by assessment of acreage fees; and
WHEREAS, said Rule 15 further provides that a developer's
portion of the cost shall be reimbursed to him without interest if,
and when, future property within the refund area is developed and
fees are collected; and
WHEREAS, an agreement has been prepared, the terms of
which provide for the payment by Santa Barbara Savings and Loan
Association for an eight -inch water main to serve its property
subject to reimbursement if, and when, future property within the
refund area is developed and fees are collected; and
WHEREAS, the terms and conditions of said agreement are
acceptable to the City Council of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED that the terms and condi-
tions of said agreement are hereby approved and accepted.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be,
and they are hereby, authorized and directed to execute said agree-
ment on behalf of the City Council of the City of Anaheim.
THE FOREGOING RESOLUTION is signed by me this 5thjda of
