RESOLUTION NO. 7~R- 5 --.L.._ A RESOLUTION OF THE CITY CUNCI:L OF THE CITY OF ANABEIH SUPPLEMENTING OLtJ'l'ION NO. 72R-S64 DETERMINING THE N ESSrry FOR AND DIRECTING THE ACQUISITION Y EKINENT DOMAIN or REAL PROPERTY POR ST AND PUBLIC UTILITY PURPoSES. (Maqnolia and C escent Avenues) WHEREAS, heretofore, on }28th day of Novemboer, 1972, the City Council of the City 0 Anaheim did pass its Reaolution No. 72R-564 authorizing ..condemnation of certain real. property for street and public . tility purposes and is, by this ReSOlution, supplementinq t same by increasing the area to be acquired; and WHEREAS, the City Council ~oes find and deteraine that public interest and necessity require the acquisition of all that real property herein described,! by the City of Anaheim for highway easement and public utility Jj>urposes. NOW, THEREFORE, BE :IT RESO~VED by the City Council of the City of Anaheim that public inte:test and necessity require the acquisition of the following des<j:ribe.d real property, to wit: An easement for road and public.utility purposes over, under and across the following 4escribed parcels of land, being a portion of the So~theast quarter of Section 12, Township 4 South, R4nge 11 West, in the Rancho Los Coyotes, as per map Jtecorded in Book 51, page 11, Miscellaneous Maps, records of Orange County, California. Parcel One: ...-. Beginning at the northeast corner of the Southeast quarter of said Section 12, saiq northeast corner for the purpose of this description 'being the centerline intersection of Crescent Avenue and Magnolia Avenue; thence S 00 13' 47" E, 221.00 feet along the centerline of said Magnolia Avenue; thence S 890 39' 14" W, 40.00 feet to an intersection with a line parallel with and 40.00 feet westerly of the cent~rline of said Magnolia Avenue; thence N 000 13' 17" W, 105.76 feet along said parallel line to a point; thence N 50 56' 25" W, 50.25 feet; thence S 890 46' 13" W, 8.00 feet to a point in a curve concave southwesterly and having a radius of 25.00 feet, a radial line beari.qg N 890 46' 13" E passes through said point; thence Northerly, Northwesterly and Westerly along said curve through a central angle of 900 06' 59" an arc distance of 39.32 feet to an inter- section with a line parallel with and 40.00 feet southerly of the centerline of said Crescent Avenue; thence N 00. 20' 45" W, 5.00 feet to an intersection with a line parallel with and 35.00 feet southerly of the centerline of said Crescent Avenue; thence S 890 39' 14" W, 100.00 feet along the last mentioned parallel line; thence N 740 47' 43" W, 74.60 feet to an intersection with a line parallel with and 15.00 feet southerly of the centerline -1- T - .............. ~. of said Crescent Avenue; thencel N 000 20' 46" W, 15.00 feet to the centerline of said Crescent Avenue; thence I N 8'0 39' 14" E, 250.00 feet alpng the centerline of said Crescent Avenue to the poi.p.tof beginning. BE IT FUIlTHER RESOLVED tha~ the City Council find, and it does hereby find and determine, ~t public inte;:est. and necessity require the acquisition of said property by the City of Anaheim for the aforesaid purposes, and that the taking of the property hereinabove described is ne~essary therefor, and that the uses to which it is to be put ar~ uses authorized by law, and the taking of said property is necessary to s~ch uses. AND BE IT FURTHER RESOLVED that the City Council cloes hereby authorize the acquisition of said property by the City of Anaheim, and the City Attorney of the City of 'Anaheim is hereby directed to institute an action in eminent domain for tqe acqui- sition of the title to said property, and to pet:~ ana carry out all of the necessary proceedings and steps incident to the acqui- sition of the title to said property and obtaining immediate possession thereof.
