AWARDING A CONTRACT TO THE ST RESPONSIBLE
BIDDER FOR THE FURNISHING OF1 ALL PLANT, LABOR,
SERVICES, MATERIALS AND EQUI~MENT AND ALL
UTILITIES AND TRANSPORTATION, INCLUDING POl~~R,

WHEREAS, the City Council of: the City of Anahci,." rHo]
cause to be published in a newspaper o~ general circulation,
printed, published and circulated in the City of Anaheir1, to
wit: The Anaheim Bulletin, on Dec~r 14 and December 21,

All plant, labor, services, mater~als and equipment, and
all utilities and transportation, including power, fuel
and water, and performing all wor~ necessary to construct
and complete in a good and workMa~like manner, in strict
accordance with the specification~, plans and drawings
therefor on file in the Office of'the City Enqineer or
City Clerk of the City of Anaheim, the followinq public
improvement, to wit:
Carpeting and floor covering, ~aheim Hills Golf
Course Clubhouse, 6601 Walnut C~yon Road, in the
Cit~ of Anaheim, consisting of ~urnishing, fitting
and installing carpeting includ~ng padding and
accessories together with furni~hing and installing
golf spike resistant floor cove~ing and edge strip
in the Anaheim Hills Golf Cours~ Clubhouse, in
accordance with the plans and specifications on file
in the Office of the City Clerk or City Engineer,
WOrk Order No. 1513.
in accordance with the design, plans, ~rofiles and specifications
of said public improvement on file in the Office of the City
Clerk of the City of Anaheim; and

WHEREAS, said notice invitin~ sealed proposals for said
public improvement did provide that se4l~ proposals would be
received by the City of Anaheim at the Office of the City Clerk
of the City of Anaheim up to the hour ~f 2:00 o'clock P.M. on

particula~ly mentioned and described,: and which notice did state
and declare that pursuant to the prov~sions of Section 1770 of
the Labor Code, the City Council of tre City of Anaheim had as-
certained the prevailing rate of wage~ in the locality in which
this type of labor is to be performed; for each craft or type of
workman or mechanic needed to execute! the contract, and which
wage scale is on file in the Offices pf the city Clerk and City
Engineer.
WHEREAS, the City Clerk of, the City of Anaheim did
receive the following sealed proposal~ prior to 2:00 o'clock P.M.
on the 28th day of December , a9 72 , in response to the
notice aforesaid inviting sealed proppsals, to wit:

AND WHERBAS, the City Engi~eer did thereupon examine
and tabulate said sealed proposals an~ did report to the City

WHEREAS, the City Council finds that the sealed pro-

of all plant, labor, services, materi Is and equipment, all
utilities and transportation, includin, power, fuel and water
and performinq all work necessary to ~onstruct and complete in
a good and workmanlike manner, in str~ct accordance with the
specification., plans and drawings th~r.for on file in the Office
of the City Clerk of the City of Anah.im, the public improvement
hereinabove mentioned and described, ~ogether with the appurte-
nances thereto, and as specified in the notice inviting .ealed
proposals, and that said proposal of .aid above-named bidder
should be accepted and a contract awarded to said bidder in
accordance therewith; and
WHEREAS, the City Council finds that the above-mentioned
sealed proposal is the lowest respons~ble proposal received and
that the person, fir.m or corporation .ubmittinq said proposal is
a responsible person, fir.m or corpora~ion and that the proposal
submitted is the best suited and fitt_d for the public improve-
ment to be constructed.
NOW, THEUFORE, BE IT RESO~VED by the City Council of
the City of Anaheim, that the sealed proposal submitted by

necessary to construct and complete, in a. good and workmanlike
manner, in strict accordance with the spebifications, plans and
drawings therefor on file in the Office o~ the City Clerk of the
City of Anaheim and the notice inviting sbaled proposals, the
public works and improvement hereinabove ~re particularly men-
tio..a and described, together with the appurtenances thereto,
be, and the same is hereby, accepted, andl that a contract for the
construction and completion of said publib improvement be, and
the same is hereby, awarded to the said a~ove-named bidder.
AND BE IT FURTHER RESOLVED that: the successful bidder
or bidders upon each contract awarded as hereinabove set forth,
shall be, and they are hereby required tol execute a contract in
the required form with the City of Anahei~ upon the terms and
conditions specified in the notice invitihg sealed proposals and
the proposal submitted by said successful! bidder or bidders and
in accordance with the plans and specific~tions for said puhlic
improvement hereinabove described, and in accordance with the
terms, conditions and provisions of this tesolution, and th~t
said successful bidder or bidders to whom each contract is awarded
sh_ll be required to furnish a surety bond in an amount equal to
one hundred per cent (100\) of the contrapt price for all labor,
materials and equipment to be furnished a~d performed, as set
forth in the sealed proposal submitted by said bidder for the
co..truction of said public improvement, together with the aDl"lUr-
teBaneea thereto or such portion thereof as is covered by said
co.tract, as security for the faithful performance of said contract,
an. a separate surety bond in an amount equal to one hundred per
cent (100\) of the construction cost of said public improvement
covered by said contract, as security for the payment of all persons
performing labor and furnishing material for said project.
AND BE IT FURTHER RESOLVED that said successf~l bidder
or bidders be, and they are hereby requir.d to furnish to the
City of Anaheim in companies satisfactory to the City of Anaheim,
p~lic liability, property damage, compensation, and other insur-
ance in the amounts and for the purposes set forth and snecif.ied
in the notice inviting sealed proposals, and subject to the
approval of the City Attorney as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby~ authorized
an4 directed to make, execute and enter into, for and on behalf
of the City of Anaheim, a written contrac~ with said sU9cess~ul
bi~der or bidders for the furnishing of all plant, labor, materials,
an4 equipment and performing all work, as hereinabove more parti-
cularly described, for the construction, installation and comple-
ti~n of said public improvement hereinabo.e described upon the
tet-ms and conditions as specified in the notice invitinq sealed
pr$poaals, the detailed design, plans, pr~files, drawinqs and
ge.eral specifications and detailed specifications and drawings,
an4 all addenda thereto, and all modifications incorporated therein
prior to the date of the opening of bids, on file in the Office of
the City Clerk of the City of Anaheim and in strict accordance .
with the terms, conditions and provisions of this resolution, and
in accordance with all of the contract doeuments herein specified.
