1976-592• 0 RESOLUTION NO. 76R- 592 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO VACATE AND ABANDON CERTAIN REAL PROPERTY AND FIXING A DATE FOR HEARING THEREON. WHEREAS, the City Council of the City of Anaheim has elected to proceed under the provisions of the Street Vacation Act of 1941 in connection with a request for vacation and aban- donment of a portion of Jefferson Street lying easterly of Tustin Avenue between La Palma Avenue and Coronado Street, in the. City of Anaheim, and more fully hereinafter described, sub- ject to the following conditions: 1. Reserving therefrom unto the City of Anaheim an easement for public utility purposes, sanitary sewer line and storm drain purposes together with all reasonable rights of ingress and egress in and to all of the area proposed for abandonment to accomo- date existing and future facilities. 2. Reserving unto the Southern California Gas Company an easement 10 feet wide over, under and across the westerly 10 feet of the west half of said Jefferson Street. 3. Reserving unto the Pacific Telephone Company a 5 -foot easement under, over and across the westerly 5 feet of the east half of Jefferson Street to construct, place, operate, inspect, maintain, repair, replace and remove such aerial and underground telephone, telegraph and communication structures as the company may from time to time require consisting of poles, anchors, wires, cables, conduits, manholes, markers and necessary fixtures and appurtenances. 4. That an encroachment permit be issued to provide a permit to accommodate the parking and landscaping proposed to be installed within the reserved easement area, including the parcel located west of the area to be abandoned lying east of Tustin. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it hereby declares its intention to vacate, abandon and close to public use a portion of Jefferson Street lying easterly of Tustin Avenue between La Palma Avenue and Coronado Street, in the City of Anaheim, as it may relate to the following described property: That portion of dedicated roadway commonly known as Jefferson Street, located in the City of Anaheim, County of Orange, State of California, to be abandoned,described as follows: Commencing at the centerline intersection of Tustin Avenue and Eagle Drive, as shown on a map recorded in Book 72, page 38 of Parcel Maps, in the office of the County Re- corder of said Orange County; thence S 89° 52' 301, E, 2.46 feet; thence N 2° 16' 30'° E, 70.13 feet; thence East 53.04 feet to the true point of beginning; thence N 20 16' 30" E 30 230 feet; thence N 2° 16' 3V E, 196.19 feet; thence East - 1 - 76- 2A U 12.66 feet to a point in a non -tangent curve concave northwesterly and having a radius of 107.00 feet, a radial line bearing S 53' 13' 30' E passes through said point; thence South�,�esterly along said curve through a central angle of 20' 51' 141� an arc distance of 38.94 feet to a point, a radial line bearing S 32' 22' 16 E passes through said point; thence S 2W 16' 30' EY 104.21 feet to a point in a curve in the easterly right of way line of Tustin Avenue 120 feet wide, having a radius of 11260.00 feet,, a radial line bearing N 710 44' 55" E passes through said point; thence Southeasterly along said curve,, also being said easterly right of way line of Tustin Avenue through a central angle of 131' 44' 09' an arc distance of 302.07 feet to a point, a radial line bearing N 85' 29' 04' E passes through said point; thence ;past 1.84 feet to the true point of beginning. As shown on map attached hereto and made a part hereof. Reserving therefrom unto the City of Anaheim an easement for public utility purposes, a sanitary sewer line and storm drain purposes together with all reasonable rights of ingress and egress in and to all of the area proposed for abandonment to accommodate existing facilities. Reserving unto the Southern California Gas Company an easement 10 feet wide over, under and across the westerly 10 feet of the west half of said Jefferson Street. Reserving unto the Pacific Telephone Company a 5 -foot ease- ment under, over and across the westerly 5 feet of the east half of Jefferson Street to construct, place, operate, in- spect, maintain, repair, replace and remove such aerial and underground telephone, telegraph and communication struc- turesas the company may from time to time require consist- ing of poles, anchors, wires, cables., conduits, manholes, markers and necessary fixtures and appurtenances. and it elects to proceed under the provisions of the Street Vacation Act of 1941, subject to the conditions hereinabove set forth. BE IT FURTHER RESOLVED that a time and place for hear- ing all persons interested in or objecting to the proposed vaca- tion and abandonment has been fixed on the 12th day of October 1976, at 2:30 o'clock P. M. in the Council CTamer in the—Cl—ty Hall in the City of Anaheim. AND BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage of this Resolution and shall cause the same to be published in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said C) City of Anaheim.
