1976-556RESOLUTION No. 76R-556 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT 4DNo. 1636 . WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from William P. and Emma S. Bregder, owners; Elmer Childs, agent, to permit an 80 -unit motel on the following described property: PARCEL 1: The Westerly 54 feet of Lot 1 of Tract No. 2222, in the City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in book 113, pages 23, 24 and 25, Miscellaneous Maps, records of said Orange County; EXCEPTING THEREFROM the Northerly 100.00 feet thereof. PARCEL 2: The Easterly 54.00 feet of the Westerly 108.00 feet of Lot 1 of Tract No. 2222, in the City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in book 113, pages 23, 24 and 25, Miscellaneous Maps, records of said Orange County; EXCEPTING THEREFROM the Northerly 100.00 feet thereof. PARCEL 3: The Easterly 54.00 feet of the Westerly 162.00 feet of Lot 1 of Tract No. 2222, in the City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in book 113, pages 23, 24 and 25, Miscellaneous Maps, records of said Orange County; EXCEPTING THEREFROM the Northerly 100.00 feet thereof. PARCEL 4: The Easterly 54.00 feet of the Westerly 216.00 feet of Lot 1 of Tract No. 2222, in the City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in book 113, pages 23, 24 and 25, Miscellaneous Maps, records of said Orange County. PARCEL 5: The Northerly 100 feet of the Westerly 162 feet of Lot 1 of Tract No. 2222, in the City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in book 113, pages 23 to 25, inclusive, Miscellaneous Maps, records of said Orange County. -1- • AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on ' July "1'9 , 1976 , notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No.'PC76_139 Series approving Conditional Use ermit No. 1636 subject to 'conditions ; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in approving said conditional use permit and did thereupon fix the 9th day of September , 1976 , as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consid- eration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a, manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. -2- 0 • NOW, THEREFORE, BE IT RESOLVED by. the City Council of the City of Anaheim that the action of the City Planning Commission 11approved said conditional use permit be, and the same is hereby, sustained , and that Conditional Use Permit No. 1636 be, and the same is hereby, granted permitting an 80 -unit motel on the aforedecribed property; and said conditional use permit is granted, subject to the following conditions: 1. That the owners of subject property shall pay to the City of Anaheim the sum of sixty (60) cents per front foot along Katella Avenue for tree planting purposes. 2. That the owners of subject property shall install street trees in the public parkway along Easy Way in accordance with City specifications and subject to the approval of the Superintendent of Parkway Maintenance. 3. That the owners of subject property shall pay to the City of Anaheim the sum of two dollars ($2.00) per front foot along Katella Avenue and Easy Way for street lighting purposes. 4. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works, as stipulated to by the petitioner. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That any parking area lighting proposed shall be down -lighted and directed away from the northerly property line to protect the adjacent residential uses. 7. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1 (Revision 1), and 2 through 4; provided, however, that kitchen efficiency units with a maximum of 8 -cubic foot refrigerators, two burner drop-in type stoves with warming ovens, and single compartment sinks may be installed, except that the manager's unit will be allowed to have full kitchen facilities. 8. That Conditions Nos. 1 and 3, above-mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission and/or City Council may grant. 9. That Conditions Nos. 2, 4, 6 and 7, above-mentioned, shall be complied with prior to final building and zoning inspections. 10. That the maximum length of tenancy in the motel units shall not exceed two (2) weeks, as stipulated to by the petitioner. 11. Total kitchen units shall be limited to 25% of the total number of the units. - 3- 0 The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
