RESOLUTIO14 NO. 76R 535
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS OF AN AGREEMENT
BETWEEN THE CITY OF ANAHEIM AND BALDWIN BUILDING
CONTRACTORS RE REIMBURSEMENT OF COSTS FOR SPECIAL
WATER FACILITIES, AND AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE SAID AGREEMENT.
WHEREAS, Baldwin Building Contractors has applied
to the City for water facilities to serve Tracts 9213 and
9214; and
WHEREAS, the City is unable to furnish water to
said Tract in the absence of special facilities as defined
pursuant to Rule into. 15 of the Water Rules of the City of
Anaheim; and
41HEREAS, Baldwin Building Contractors is willing
to pay the City its share of prior advances pursuant to
said Rule No. 15 and the City is willing to attempt to
collect from the ultimate users of said special facilities,
and/or persons within the Special Facility's District No. 1,
the fees necessary to reimburse Baldwin Building, Contractors
towards the cost of said special facilities; and
WHEREAS, an agreement has been prepared, the
terms and conditions of which are satisfactory to and in
the best interests of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of an
agreement between the City of Anaheim and Baldwin Building
Contractors in connection with the reimbursement of costs
for special water facilities be, and the same are hereby,
approved.
BE IT FURTHER RESOLVED that the Mayor and City
Clerk are hereby authorized to execute said agreement on
behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed
by me this 7th day of September , 1976.
