BIDDER FOR THE FURNISHING F ALL PLANT, LABOR,
SERVICES, MATERIALS AND EO IPMENT AND ALL
UTILITIES AND TRANSPORTATI N, INCLUDING POWER,

and declare that pursuant to the pro isions of Section 1770 of
the Labor COde, the City Council of he City of Anaheim had as-
certained the prevailing rate of wag s in the locality in which
this type of labor is to be performe for each craft or type of
workman or Mechanic needed to execut the contract, and which
wag~ scale is on file in the Offices of the City Clerk and City
Bng1neer.
WHEREAS, the City Clerk of !the City of Anaheim did

AND WHEREAS, the City Engiieer did thereupon examine
and tabulate said sealed proposals a d did report to the City
COuncil the result of his examinatio and tabulation; and
WHEREAS, the City Council inds that the sealed pro-

of all plant, labor, services, mater als and equipment, all
utilities and transportation, includ ng power, fuel and water
and perforaing all work necessary to construct and complete in
a good and workmanlike manner, in sttict accordance with the
specifications, plans and drawings t~erefor on file in the Office
of the City Clerk of the City of Anaheim, the public improvement
hereinabove mentioned and described,' together with the appurte-,
Dances thereto, and as specified in the notice inviting sealed
proposals, and that said proposal of said above-named bidder
ahould be accepted and a contract aw.rded to said bidder in
accordance therewith; and

WHEREAS, the City Council ~inds that the above-mentioned
sealed proposal is the lowest respon~ible proposal received and
that the person, firm or corporation! submitting said proposal is
a responsible person, firm or corpor~tion and that t~e proposal

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheia, that the sealedf proposal submitted by

necessary to construct and complete, in ~ good and workmanlike

City of Anaheim and the notice invitinq ~ealed proposals, the
pUblic works and improvement hereinabove!more particularly rnen-
t~oft8d and described, together with the 4ppurtenances thereto,
be, and the same is hereby, accepted, an4 that a contract for the
construction and completion of said publ~c imorovement be, and
the same is hereby, awarded to the said ~bove-named bidder.
AND BE IT FURTHER RES0LVED tha~ the successful bidder
or" bidders upon each contract awarded aS~hereinabove set forth,
shell be, and they are hereby required t execute a contract in
the required form with the City of Anahe'm upon the terms and
conditions specified in the notice invit~ng sealed proposals and
the proposal submitted by said successfu] bidder or bidders and
in aocordance with the plans and specifidations for said public
improvement hereinabove described,' and i~ accordance with- the
tet'as, conditions and provisions of this !resolution, and that
sa4.d successful bidder or bidders to whorni each contract is awarded
shall be required to furnish a surety bo~ in an amount equal to
one hundred per cent (100\) of the contra~t price for all labor,
materials and equipment to be furnished a~d performed, as set
forth in the sealed proposal submitted by said bidder for the
construction of said public improvement, ~ogether with the annur-
tenanees thereto or such portion thereof ~s is covered by sain
contract, ,as security for the faithful pe~formance of ~ai,d c~ntract,
and a separate surety bond in an amount equal to one h\Jndred'per
cent (100\) of the construction cost of s~id publiq ~provement
covered by said contract, as security for the payrneht of all perS()ns
performing labor and furniShing material for said project.
AND BE IT FURTHER RESOLVED that said suceessful bidder
or bidders be, and they are hereby requir~d to furnish to the
City of Anaheim in companies satisfactory to the Ci:."tyof Ana~e-im,
p~lic liability, property damage, compen.ation, and o~n~ insur-
ance in the amounts and for the purposes $let forth ana~!>ecified
in the notice inviting sealed proposals, and subject to the
ap~roval of the City Attorney as to form and SUfficiency.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, au~horized
and directed to make, execute and enter i~to, for and on behalf
of the City of Anaheim, a written contract with said successrul
bidder or bidders for the furnishing of a~l plant, labor, materials,
and equipment and performing all work, as hereinabove more parti-
Cularly described, for the construction, installation and comple-
tion of said public improvement hereinabove described upon the
t...s and conditions as specified in the *otice in~itinq sealed
proposals, the detailed design, plans, pr~files, draw~ngs and
general specifications and detailed speci~ications and drawings,
and all addenda thereto, and all rnodifica~ions incorporated ~herein
prior to the date of the opening of bids, on file in the Office of
the City Clerk of the City of Anaheim and in strict accordance
with the terms, conditions and provisions of this resolution, and
in acoordance with all of the contract dOCuments herein specified.
