HHEREAS, after a request for variance by Eugene, Ann and. Gordon Lentzner, owners; Family Health Program, agent, was received, a public hearing before -;'_-he Plannincf CormAssion of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 2827 was granted covering the following de- scribed property: All that certain land situated in the State of California, Couxity of Orange, City of Anaheim, de- cribed as follows: That portion of the Southwest quarter of Section 6, Township 4 South, Range 10 Wes -L, in the Rancho Los Coyotes as shown on a map recorded in Book 51, page 10 of Miscellaneous Maps, records of said County described as follows: Beginning at a point on the Southerly line of Parcel 1, as shown on a Parcel 14ap -filed in Book 40, page 16 of Parcel 11aps, records of said County distant • thereon South 890 211 00" West, 265.00 feet from the Southeast corner of said Parcel 1; thence South 00 391 00" East parallel with the Easterly line of said Parcel 1, a distance of 352.67 feet, thence, South 890 171 15" West, 393.00 -feet to the Westerly line of said Southwest one-(�Auarter; thence, North0°391 00" West, along said Westerly line, 353.10 feet to the Westerly prolongation of the Southerly line of said Parcel 1; thence, North 890 211 00" East, along said Southerly line, 393.00 feet to the point of be- ginning. 1,^T-4EREAS, thereafter, within the time prescribed by law an interested Darty or the City Council on its own motion caused the review of said Planning CowxAssion action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the Property including size, shape, topography, location or surround- ings, which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classification in the vicinity. -1- 0 0 • NOW, THEREFORE, BE IT RESOLVED by the City Council of • the City of Anaheim that a conditional zoning variance be, and the same is hereby, granted permitting the construction of a medi- cal/dental office complex on the property hereinbefore described with waivers of the following section of the Anaheim .Municipal Code: SECTION 16.61.020 - Permitted uses. (Medical/dental office complex with auxiliary medical service not permitted) That said variance be granted subject to the following conditions: 1. That sidewalks shall be installed as required by the City Engineer and in accordance with standard plans and specifica- tions on file in the Office of the City Engineer. 2. That street lighting facilities along Magnolia Avenue shall be installed as required by the Director of Public Utilities and in accoriance with standard plans and specifications on file in the Office of the Director of Public Utilities; and/or that a bond, certificate of deposit, letter of credit, or cash in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned requirements. 3. That the owner (s) of subject property shall pay to the City of Anaheim the sum of sixty (60) cents per front foot along Aagnolia Avenue for tree planting purposes. 4. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Pub- lic Works. 5. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That subject property shall be served by underground utilities. 7. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 3. That subject property shall be developed substantially in accordance with plans and specifications on file with the Citv of Anaheim marked Exhibit No. 1. 9., That Condition Nos. 2 and 3, above-mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building per- mit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the City Council may grant. 10. That Condition Ios. 1, 4, 6, 7 and 8, above-mentioned, shall be complied with prior to final building and zoning inspec- tions. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns to cor,iDlv with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term pre- scribed by the Anaheim, Municipal Code unless otherwise specified herein.
