1976-495RESOLUTIO: NO. 76R-495 A RESOLUTION OF TtIE CITY COUNCIL OF THE CI`T'Y OF ANAHEIII GR�xNTING CONDI`IIONAL USE PER2.1IT O. 1628. ,THEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use per. -mit from G & R Distributors, owner; H. Chamberlain, agent, to per_<<it truck and trailer rentals front a service station site on the following described property: The West 190 feet of the North 216 feet of the West half of the North half of the Ilorthwest quarter of the IKiortheast quarter of Section 14, in Township 4 South, Range 11 West, in the Rancho Los Covotes, in the City of Anaheim, as per strap recorded in book 51, page 11, Iiiscellaneous Baps, in the office of the county recorder of said. county. EnCEPT those portions of Lincoln Avenue and western Avenue, as conveyed to the State of California by deeds of record among them being deed recorded Janu- ary 20, 1956 in book 3362, page 306, Official Records, in the office of the county recorder of said. Orange County. AND WHEREAS, the City Planning ConrAssion did hold a public hearing at the City call in the City of Anaheim upon said application on June 21, 1976, which hearing was continued to July 7, 1976, notices of which said public hearing were duly given as required by law and the provisions of Title 13, Chapter 13.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC76-126 denying Conditional Use Per- mit No. 1623; and WHERE -AS, thereafter, within twenty-two (22) days from, the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Plan- ning Commission in denving said conditional use permit and said appeal was set for public hearing on August 17, 1976, at the Citv Hall, in the City of Anaheim, and notices of such public hearing were duly giver_ as required by law and the provisions of Title 16, Chapter 13.76 of the Anaheim k1unicipal Code; and WHEREAS, at the time and place fixed for said public tearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consi•- deration of the recommendations of the City Planning ConTiAssion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. -1- 0 0 0 2. The proposed use will not adversely affect -the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development- of the proposed use in a manner not detrimental to e particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not ixot- pose an undue burden upon the streets and highways designed and improved to carry the traffic is the area. - 5. The granting of the conditional use -permit under the conditions imposedl will not be detrii-Liental to the peace, health, safety and general welfare of the citizens of the City of Analheii-ii. NOW, THEREFORE, DE IT RESOLVED by the City Council of the City of Anaheim that the action of the -City Planning Com-.iission in denying said conditional use permit be, and the same is hereby, reversed, and that Conditional Use Permit No. 1628 be, and the same is hereby, granted permitting truck- and trailer rentals from a service station site on the afore -described property, siwbject to the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 45 feet in width :golf= the center- line of the street along Western Avenue for street widening ?ur- poses. 2. That the owner(s) of subject property shall pay to the City of Anaheim the sum of si,-?.tv (6.0) cents per front foot along Western Avenue and Lincoln Avenue for tree Planting purposes. That subject Property shall be developed z—o-bsUantially in accordance with plans and specifications on -file with the city of Anaheim marked Exhibit No. 1 (Revision No. 1) . 4. That no more than six (6) U -Haul trucks shall be iDerrAt_- ted on the site at any one time. 5. That Condition Nos. 1 and 2, above-mentioned, shall be complied with Prior to the co_rmlencement of -the activity authorized L_ - under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, which- ever occua:s first, or such further time as the Planning Commission and/or City Council may grant. `_'E IT FURTHER F SOLVED that the City Council hereby re- serves the right to revol-le such Conditional Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Munici-oal Code and regulations and the conditions herein.
