1976-491RESOLUTION NO. 76R- 491 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AND AUTHORIZING TETE EXECUTION BY THE 'IAYOR AND THE CITY CLERK OF A DEED AND RELINQUISH_vIENT OF LEASEHOLD INTEREST RELATING TO THE LEASE AGREEr=TENT BETWEEN THE CITY OF ANAHEIM AND ROYAL INIMS OF AISERICA, INC. DATED APRIL 11, 1969. WHEREAS, the City of Anaheim and Royal Inns of America, Inc. entered into a ground Lease Agreement dated April 11, 1969, with respect to certain real property in the City of Anaheim des- cribed in said Agreement; and WHEREAS, said Lease Agreement was recorded on February 9, 1971, as Recorder's Series No. 5385 in Boob 9540, Pages 139, et seg., of the County Records of Orange County, State of California; and jvHEREAS, Royal Inns of America, Inc. assigned and trans- ferred all of its rights, title and interest in and to the Lease to Roval Inn of Anaheim, a California limited partnership by in- strument dated August 6, 1971, which was recorded on August 20, 1971 in Book 9771, Palle 135 of the Official Records in the Office of the County Recorder of Orange County, State of California; and WHEREAS, Royal Inns of America, Inc. and Royal Inn of Anaheim have given rights to Jolly King of Anaheim, and to Earl's Seafood Grotto of Anaheim to operate restaurant and lounge busi- nesses on the Leased Parcel, which rights are in the nature of sublease, franchise, concession and other such rights; and WHEREAS, the Co -Trustees for. Royal Inns of America, Inc., a California corporation subject to Chapter X Reorganization Proceedings, has submitted to the City of Anaheim a Deed and Relinquishment of Leasehold Interest terminating, cancelling, sur- rendering and relinquishing all rights in the Lease Parcel or the improvements constructed thereon and transferring and delivering to the City of Anaheim all right, title and interest to said Lease and leasehold estate and all improvements constructed thereon, and releasing the City and the above named parties from obligations and liabilities under said Lease, the terms and conditions of which are satisfactory to the City; and WHEREAS, the City Council finds that it would be for the benefit and in the best interests of the City of Anaheim to approve the proposed Deed and Relinquishment of Leasehold Interest and that the same should be approved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the Citv of Anaheim that the Deed and Relinquishment of Leasehold Interest this day submitted to the Citv Council by the Co -Trustees for Royal Inns of America, Inc. and the above named organizations, upon the terms and conditions set forth therein be, and the same is hereby, approved.
