RESOLUTION NO. 76R- 470
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE A LAND-
SCAPE MAINTENANCE AGREEMENT BETWEEN OAKTREE-
SCOTTSDALE VENTURE AND THE CITY OF ANAHEIM.
WHEREAS, on February 20, 1973, the City Council of
the City of Anaheim adopted a resolution granting Variance
Number 2451 for Tract Number 8075; and
WHEREAS, said resolution requires the developer,
oaktree-Scottsdale Venture, and its assignees or future devel-
opers to provide reasonable landscaping, including irrigation
facilities until plantings are established, and to provide per-
petual maintenance for the slopes on certain Lots in. Tract
3075, and to submit the plans for said landscaping to and obtain
the approval of the parkway maintenance superintendent; and
WHEREAS, the developer has agreed to perform the above -
referenced undertakings; and
WHEREAS, the developer, its assignees, future devel-
opers, owners or homeowners association have agreed to provide
natural landscaping, temporary irrigation for said natural land-
scaping until plantings are established, perpetual maintenance
for such plantings in their natural state without the use of
chemicals such as fertilizers, pesticides, etc., and restrict
the use of said slope bank areas by unauthorized persons for
that slope area depicted by the shaded areas on the map at -ached
hereto as Exhibit "A-1," in accordance with all reasonable re-
quirements and subject to the approval of the City; also, that
the conditions, covenants and restrictions applicable to said
tract shall condition the usage of the said slope area in
accordance with all the provisions contained herein.
NOW, THEREFORE, BE IT RESOLVED by the C-C-ty Council of
the City of Anaheim that the above-described agreement between
Oaktree-Scottsdale Venture and the City of Anaheim be approved
and the Mayor and City Clerk be authorized and directed to
execute said agreement.
THE FOREGOING RESOLUTION is approved and signed by me
this 10th day of August 1976.
