1976-457RESOLUTION NO. 76R- 457 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO VACATE AND ABANDON CERTAIN REAL PROPERTY AND FIXING A DATE FOR HEARING THEREON. WHEREAS, the City Council of the City of Anaheim has elected to proceed under the provisions of the Street Vacation Act of 1971 and the Public Service Easement Vacation Law, Title 5, Division 1, Part 1, Chapter 2, Article 5 of the Government Code (Sec. 50430 et seq.) in connection with a request for vacation and abandonment of a portion of an existing street and public utility ease- ment, said street being commonly known as Hermosa Drive, located North of La Palma Avenue, West of West Street, in the City of Anaheim, and more fully hereinafter described, subject to the following conditions: 1. Applicant will rededicate said street and reimprove same as may be required by the City Engineer in the event that the Anaheim Memorial Hospital does not acquire the remaining property west of the subject. 2. Applicant to post a bond in an amount satis- factory to the City Engineer to cover the cost of removing existing standard cul-de- sac street improvements, and the cost to install the street improvements necessary to complete the improvements needed for the installation of the proposed modified cul- de-sac. In addition, the bond will cover the removal of the modified cul-de-sac street improvements, and the cost of reconstructing a standard cul-de-sac to return the subject street to its original condition, should Anaheim Memorial Hospital not acquire the remaining property west of the subject. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it hereby declares its intention to vacate, abandon and close to public use a portion of an existing street and public utility easement, said street being commonly known as Hermosa Drive, located North of La Palma Avneue, West of West Street, in the City of Anaheim, as it may relate to the following described property: That portion of a dedicated street, commonly known as Hermosa Drive, lying within Tract No. 1691, as per map recorded in Book 52, pages 18 and 19, Miscellaneous Maps, records of Orange County, lying within the City of Anaheim, County of Orange, State of California, described as follows: Parcel 1 Beginning at the southwest corner of Lot 18 of said Tract 1691; thence N 661 22' 46" E, 8.00 feet to the beginning of a curve concave north- westerly and having a radius of 50 feet; thence 75-16A -1- Easterly, Southeasterly, Southerly, Southwester- ly, Westerly and Northwesterly along said curve through a central angle of 240° a distance of 209.44 feet to the beginning of a reverse curve concave southwesterly and having a radius of 50 feet; thence Northwesterly along last mentioned curve through a central angle of 601 an are distance of 52.36 feet to an intersection with a line parallel with and 25 feet southerly of the centerline of said Hermosa Drive; thence N 660 221 46" E, 53.60 feet to the beginning of a curve concave southwesterly and having a radius of 25 feet; thence Easterly, Northeasterly and Northerly along said curve through a central angle of 900 an arc distance of 39.27 feet to an intersection with the southerly prolongation of the west line of Lot 18 in said Tract 1691; thence N 230 371 1411 W, 25 feet to the point of beginning. Parcel 2 That certain public utility easement to be abandoned lying within said Tract No. 1691, described as follows: The Westerly 5 feet of Lot 17 and the Easterly 5 feet of Lot 18 in Tract 1691, as shown on a map recorded in Book 52, pages 18 and 19, Miscellaneous Maps, records of said Orange County. Except therefrom the northerly 6 feet thereof. and it elects to proceed under the provisions of the Street Vacation Act of 1971 and the Public Service Easement - Vacation Law, Title 5, Division 1, Part 1, Chapter 2, Article 5 of the Government Code (Sec. 50430 et seq.), subject to the conditions hereinabove set forth. BE IT FURTHER RESOLVED that a time and place for hearing all persons interested in or objecting to the proposed vacation and abandonment has been fixed on the 24th day of August , 1976, at 2:30 o'clock P.M. in the Council Chamber in the City Hall in the City of Anaheim. AND BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage of this resolution and shall cause the same to be published in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City of Anaheim.
