A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF A SETTLEMENT AGREEMENT WITH DANIEL, MANN,
JOHNSON & MENDENHALL, AND AUTHORIZING THE
MAYOR AND THE CITY CLERK TO EXECUTE SAID
AGREEMENT ON BEHALF OF THE CITY OF ANAHEIM.
WHEREAS, the City of Anaheim and Daniel, Mann,
Johnson & Mendenhall entered into an Agreement, dated
March 14, 1972, wherein Daniel, Mann, Johnson & Mendenhall
was to conduct a comprehensive analysis and provide
recommendations with supporting data for the design of a
220-69 kV Substation at City's Lewis Substation; and
WHEREAS, the Agreement between the parties
provided that the amount to be paid to Daniel, mann,
Johnson & Mendenhall would not exceed Nine Thousand Seven
Hundred and Seventy -Five Dollars ($9,775); and
WHEREAS, a dispute has arisen between the parties
as to whether the City of Anaheim requested Daniel, Mann,
Johnson & Mendenhall to perform services beyond the scope
of the Agreement, dated March 14, 1972; and
WHEREAS, the parties desire to settle said dispute
without litigation.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that a Settlement Agreement between
the City of Anaheim and Daniel, Mann, Johnson & Mendenhall,
dated August 3, 1976, be, and the same is hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City
Clerk are hereby authorized to execute said Settlement
Agreement on behalf of the City of Anaheim.
