1977-520RESOLUTION NO. 77R-520 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE SHOULD NOT BE GRANTED IN A CERTAIN AREA OF THE CITY HEREINAFTER DESCRIBED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its intention to change the boundaries of the zone or zones hereinafter mentioned and described, and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending an amendment to said Title 18 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommenda- tion of the City Planning Commission, the City Council did thereupon fix the 19th day of July 1977 and continued to the day of 19 as the time and the Council Chamber in the City Hall Fr City of Anaheim as the place for a public hearing upon said proposed change of zone or zones, and did give notice thereof in the manner and as provided in said Title 15 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone or zones in which it is now situated to a different zone or zones, as hereinafter set forth, is more suitable for the zone or zones in which it is now incorporated, and that a change of zone should not be granted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: -1- 76 -77 -50 That portion of the South West Quarter of Section 4, Township 4 South, Range 10 West, partly within the Rancho Los Coyotes and partly in the Rancho San Juan Cajon de Santa Ana, as shown on a reap recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the Southwest corner of said Section 4; thence Northerly along the West line of said Section 4 to a point in the Westerly prolongation of the South line of Lot 2, as said Lot 2 is shown on a Map filed in Book 1, page 55 of Record of Surveys, in the office of the County Recorder of Orange County, California; thence Easterly along said Westerly prolongation and along said South line of Lot 2 to the Southwest corner of Lot 3, as said Lot 3 is shown on a Map filed in Book 1, page 55 of Record of Surveys, in the Office of the County Recorder of Orange County, California; thence Southerly along the Southerly prolongation of the West of said Lot 3 to a point in the South line of said Section 4; thence Westerly along said South line of Section 4, to the point of beginning. Excepting therefrom the West 416.00 feet. That certain parcel of land described in a deed recorded May 1, 1973 in Book 10672, Page 2_87 of Official Records in the office of the County Recorder of Orange County, more particularly described as follows: That portion of the South one -half and the South 27 feet of the North one -half of Lot 2 of a part of Section 4, Township 4 South, Range 10 West as per Map filed in Book 1, Page 55 of Record of Surveys in the office of the County Recorder of Orange County in the City of Anaheim, County of Orange, State of California. Excepting therefrom the West 416.00 feet. -2- remain in "RS A 43,000" RESIDENTIAL /AGRICULTURAL ZONE in which it is now incorporated, and that the reclassification to "RM -1200" RESIDENTIAL, MULTIPLE- FAMILY ZONE as recommended by the City Planning Commission in its Resolution No. PC77 -105 be denied.
