A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AN AGREEMENT WITH
W. R. GRACE PROPERTIES, INC. IN CONNECTION
WITH THE REIMBURSEMENT OF PRIOR ADVANCES FOR
SPECIAL WATER FACILITIES TO SERVE TRACT 9268,
AND TO AUTHORIZE THE MAYOR AND CITY CLERK TO
EXECUTE SAID AGREEMENT.
WHEREAS, W. R. Grace Properties, Inc. has applied
to the City of Anaheim for water facilities to serve Tract
9268 in the City of Anaheim; and
WHEREAS, the City of Anaheim is unable to furnish
water to said Tract at an adequate pressure level to serve
said Tract in the absence of special facilities as defined
pursuant to Rule No. 15 of the Water Rules of the City of
Anaheim; and
WHEREAS, W. R. Grace Properties, Inc. is willing
to pay to the City of Anaheim its share of Prior Advances
pursuant to said Rule No. 15, and the City is willing to
attempt to collect from the ultimate users of said special
facilities, and /or persons within the Special Facility's
District No. 1, the fees necessary to reimburse the W. R.
Grace Properties, Inc. towards the cost of said special
facilities; and
WHEREAS, an Agreement has been prepared in order
to accomplish the collection of W. R. Grace Properties, Inc.'s
share of Prior Advances and establish a method of reimburse-
ment, the terms of which are satisfactory to the City of
Anaheim; and
WHEREAS, it is in the best interests of the City
of Anaheim to enter into said Agreement.
NOW, THEREFORE, BE IT RESOLVED by ,the City Council
of the City of Anaheim that the Agreement between the City
of Anaheim and W. R. Grace Properties, Inc. in connection
with the payment of Prior Advances and reimbursement therefor,
for Special Water Facilities to serve Tract 9268 be, and the
same is hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City
Clerk are hereby authorized to execute said Agreement for
and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
