1977-358WHEREAS, heretofore, to wit, on the 5th day of April,
1977, the City Council of the City of Anaheim did adopt
Resolution No. 77R -237 finding and determining that public
convenience and necessity required the construction and com-
pletion of the Timken Road /Coyote Lane Sewer Improvement; and
WHEREAS, the City Council did authorize and direct
the City Clerk to publish a notice according to law inviting
sealed proposals for the above mentioned public improvement
and fixing the 28th day of April, 1977, at the hour of 2:00
o'clock p.m., as the date and hour for the opening of said bids
in the Council Chamber in the City Hall in the City of Anaheim;
and
WHEREAS, upon said 28th day of April, 1977, at the
hour of 2:00 o'clock p.m., the City Clerk and City Engineer
did open the bids received up to that hour, in public, in the
City Hall, in the City of Anaheim, and the City Engineer did
review the bids so received and did report the results thereof
to the City Council at its regular meeting held on the 17th day
of May, 1977; and
WHEREAS, the City Council finds that because all
necessary easements to construct this sanitary sewer project
have not been obtained that said bids should be rejected.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the bids received up to the hour of
2:00 o'clock p.m., on the 28th day of April, 1977, reviewed by
the City Engineer and submitted to the City Council on May 17,
1977, be and the same are hereby, rejected.
THE FOREGOING RESOLUTION is approved and signed by me
this 17th day of May, 1977.
