1977-320RESOLUTION NO. 77R -32.0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAIIEIM GRANTIIG VARIANCE NO. 2922, IN PART. WHEREAS, after a request for variance by EUCLID ROMNEYA COMPANY, owner, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2922 was granted, in part, covering the following described property: The land referred to in this policy is situated in the State of California, County of Orange, City of Anaheim, and is described as follows: Lots 1, 2, 3, 4 and 5 of Tract No. 3396, as shown on a Map recorded in Book 121, Pages 8 and 9 of Miscellaneous Maps, in the office of the County Recorder of said County. Except that portion thereof included within the following described land: Beginning at the Southwest corner of the Northwest quarter of the Southwest quarter of Section 4, Township 4 South, Range 10 West, as shown on said map of Tract No. 3396; thence South 89° 42' 57" East 203.00 feet along the Southerly line of said Northwest quarter; thence North 0 02' 23" East 180.00 feet parallel with the Westerly line of said Section; thence North 89° 42' 57" West 203.00 feet to the Westerly line of said Section; thence South 0 02' 23" West 180.00 feet to the point of beginning. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. -1- 2. That, because of special circumstances shown in (1) above, strict application of the zoning, code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that a conditional zoning variance be, and the same is hereby, granted, in part, permitting the construction of four free standing signs and an auto repair facility on the property hereinbefore described with waivers of the following sections of the Anaheim municipal Code: SECTION 10.05.093.021 Maximum number of signs. (1 free standing sign permitted; 4 proposed) SECTION 18.05.093.0231 Iiinimum distance between signs. (300 ft. required; 110 to 235 ft. proposed) SECTION 18.44.020 Permitted uses. (Auto repair not a permitted use in the CL Zone) That said variance be granted, in part, subject to the following conditions: 1. That this Variance is granted, in part, subject to the completion of Reclassification No. 58 -59 -31 readvertised, now pending. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1 through 3; provided, however, that the proposed sign adjacent to Euclid Street shall be eliminated, and the remaining two signs adjacent to Euclid Street shall be relocated as approved by the Planning Department; that the maximum total sign area permitted on subject property shall be 350 square feet; that the proposed sign adjacent to Romneya Drive shall be relocated in accordance to Code standards; and that additional trash storage areas as required by the Sanitation Division shall be provided in accordance with approved plans on file with the Office of the Public Works Director, as stipulated to by the petitioner. -2- 3. That the automotive repair activity shall consist of the installation or mounting of tires, front -end work, front -end alignment and installation of shock absorbers and brakes only, in conjunction with tire sales, and shall be conducted entirely inside the building, as stipulated to by the petitioner. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise speci- fied herein. THE FOREGOING RESOLUTION is approved and signed by me this 3rd day of May, 1977.
