1977-305ATTY 18 -C (Page 1 of 2 pages) RESOLUTION NO. 77R -305 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 76 -77 -45 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission, the City Council did fix the 26th day of April 19 77, and continued to the day of 19 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportun- ity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. -1- 76 -77 -45 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municinal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of the land allotted to Paula Peralta de Dominguez, in the City of Anaheim, County of Orange, State of California, as described in the final decree of partition of the Rancho Santiago de Santa Ana, which was entered September 12, 1868 in Book "B Page 410 of Judgments of the District Court of the 17th Judicial District in and for Los Angeles County, California, described as follows: BEGINNING at a point in that certain course of the centerline of the strip of land (78.00 feet in width) described as "South 83° 59' 55" East, 908.05 feet" in Parcel 1 of the Deed to the City of Anaheim, a muni- cipal corporation, recorded in Book 11270, Page 1734 of Official Records in the Office of the County Re- corder of said County; said point being distant thereon North 83° 59' 55" West, 338.01 feet from the easterly terminus of said course; thence leaving said course North 6° 00' 05" East, 39.00 feet; thence par- allel with said course South 83° 59' 55" East, 12.41 feet; thence NORTH, 115.35 feet to a point on a non tangent curve concave northwesterly and having a ra- dius of 380.00 feet; a radial line of said curve from said point bears North 5° 44' 55" East; thence east- erly and northeasterly along said curve 240.47 feet through a central angle of 36° 15' 28 thence non- tangent to said curve North 43° 28' 00" East, 18.32 feet; thence North 38° 32' 00" East, 34.52 feet; thence North 32° 25' 00" East, 51.29 feet; thence North 39° 24' 00" East, 99.26 feet; thence NORTH, 245.39 feet; thence EAST, 288.70 feet; thence South 53° 28' 00" East, 663.10 feet; thence along said southwesterly line South 25° 22' 20" East, 111.86 feet to the beginning of a tangent curve con- cave southwesterly and having a radius of 275.00 feet; thence southeasterly along said curve 125.36 feet through a central angle of 26° 07' 06" to that cer- tain course in the centerline of said strip of land, ATTY -18 -C (Page 2 of 2 pages) -2- (78.00 feet in width) described in Parcel 1 of the Deed to the City of Anaheim as "South 81° 32' 26" East, 743.41 feet thence along the centerline of said strip of land, North 81° 32' 26" West, 477.03 feet to the beginning of a tangent curve, concave northeasterly and having a radius of 800.00 feet; thence northwesterly along said curve 316.82 feet through a central angle of 22° 41' 27 thence tan- gent to said curve North 58° 50' 59" West, 696.10 feet to the beginning of a tangent curve concave southwesterly and having a radius of 1000.00 feet; thence northwesterly along said curve 438.93 feet through a central angle of 25° 08' 56 thence tan- gent to said curve, North 83° 59' 55" West, 338.01 feet to the POINT OF BEGINNING. be excluded from "RS- A- 43,000(SC)" RESIDENTIAL /AGRICULTURAL (SCENIC CORRIDOR OVERLAY) ZONE and incorporated in "RS- HS- 10,000(SC)" RESI- DENTIAL, SINGLE- FAMILY HILLSIDE (SCENIC CORRIDOR OVERLAY) ZONE, subject to the following conditions: 1. That a final tract map of subject property shall be sub- mitted to and approved by the City Council and then be recorded in the Office of the Orange County Recorder. 2. In the event that subject property is to be divided for the purpose of sale, lease or financing, a parcel map, to record the approved division of subject property, shall be submitted to and approved by the City of Anaheim and then be recorded in the Office of the Orange County Recorder. 3. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 4. That subject property shall be served by underground utilities. 5. Prior to the introduction of an ordinance rezoning sub- ject property, Condition Nos. 1 and 2, above- mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 6. That Condition No. 4, above- mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
