1977-299WHEREAS, Canyon Village, a limited partnership;
Raymond G. Spehar, Trustee, Estelle K. Spehar, Trustee,
husband and wife; and Marcia Ann Halligan, a married woman,
hereinafter referred to as Licensees, are the owners of
property in the City of Anaheim over which the City owns a
public utility easement; and
WHEREAS, Licensees wish to encroach upon a portion
of said easement for the purpose of connecting a private
storm drain to a Master Plan 72 -inch storm drain; and
WHEREAS, unless Licensees are allowed to encroach
upon the easement of the City, an extreme and undue hardship
will be caused to Licensees; and
WHEREAS, the proposed encroachment for such instal-
lation across a portion of the easement of City will not
interfere with the present use of the easement by the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of a
license agreement between the City of Anaheim and Canyon
Village, a limited partnership; Raymond G. Spehar, Trustee,
Estelle K. Spehar, Trustee, husband and wife; and Marcia Ann
Halligan, a married woman, be and the same are hereby
approved.
BE IT FURTHER RESOLVED that the Mayor and City
Clerk be, and they are hereby, authorized to execute said
license agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and sighed by
