1977-268RESOLUTION NO. 77R -268 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 76 -77 -40 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission, the City Council did fix the 19th day of April 1977 and continued to the day of 19 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportun- ity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. ATTV -18 -C (Page 1 of 2 pages) -1- 76 -77 -40 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municinal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: ATTY -18•C (Page 2 of 2 pages) Commencing at the intersection of the centerline of Canyon Rim Road and the Easterly boundary of Tract No. 8220, as per map recorded in Book 335 Pages 33 through 41, inclusive, of Miscellaneous Maps, in the office of the County Recorder of Orange County, said point of commencing being on a curve concave South- erly and having a radius of 800.00 feet, a radial line passing through said point bears North 4° 15' 07" East; thence Easterly along the centerline of said Canyon Rim Road as described in Deed to the City of Anaheim recorded October 22, 1974 in Book 11270 Page 1734 of Official Records, records of said County, through a central angle 9° 42' 44" an arc distance of 135.61 feet; thence tangent to said curve South 76° 02' 09" East 591.65 feet to the TRUE POINT OF BEGINNING for the purposes of this descrip- tion; thence continuing along said centerline of Canyon Rim Road South 76° 02' 09" East 151.47 feet to the beginning of a tangent curve concave South- westerly having a radius of 1000.00 feet; thence Southeasterly along said curve through a central angle of 21° 14' 27" an arc distance of 370.72 feet; thence tangent to said curve South 54° 47' 42" East 422.74 feet to the beginning of a tangent curve con- cave Northeasterly having a radius of 1000.00 feet; thence Southeasterly along said curve through a cen- tral angle of 0 44' 10" an arc distance of 12.85 feet; thence leaving said centerline of Canyon. Rim Road North 31° 27' 27" East 102.17 feet; thence North 59° 33' 37" East 112.51 feet; thence North 8° 55' 50" West 354.30 feet; thence North 42° 33' 11" East 468.00 feet; thence North 60° 15' 18" West 363.00 feet; thence North 51° 00' 00" East 336.65 feet; thence North 3° 41' 29" West 257.93 feet; thence North 35° 28' 00" West 187.96 feet to the Southeasterly line of that certain Right of Way easement of Southern Cali- fornia Edison Company as per Document Recorded in Book 8824 Page 19 of Official Records, Records of said County; thence South 46° 18' 13" West along said last mentioned Southeasterly line 1382.64 feet; thence South 84° 41' 38" West 46.00 feet to the beginning of a non tangent curve concave Westerly having a radius of 600.00 feet a radial line of said curve which passes through the beginning bears North 84° 41' 38" East; thence Southerly along said curve through a cen- tral angle of 19° 16' 13" an arc distance of 201.80 feet; thence tangent to said curve South 13° 57' 51" West 41.92 feet to the TRUE POINT OF BEGINNING. -2- be excluded from "RS- A- 43,000(SC)" RESIDENTIAL /AGRICULTURAL (SCENIC CORRIDOR OVERLAY) ZONE and incorporated in "RS- H- 22,000(SC)" RESI- DENTIAL, SINGLE- FAMILY (SCENIC CORRIDOR OVERLAY) ZONE, subject to the following conditions: 1. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department, prior to commencement of structural framing. 2. In the event that subject property is to be divided for the purpose of sale, lease or financing, a parcel map, to record the approved division of subject property, shall be submitted to and approved by the City of Anaheim and then be recorded in the Office of the Orange County Recorder. 3. That the owner of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as de- termined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 4. That a final tract map of subject property shall be sub- mitted to and approved by the City Council and then be recorded in the Office of the Orange County Recorder. 5. That appropriate water assessment fees, as determined by the Director of Public Utilities, shall be paid to the City of Anaheim prior to the issuance of a building permit. 6. Prior to the introduction of an ordinance rezoning sub- ject property, Condition Nos. 2 and 4, above- mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
