A RESOLUTION OF THE CITY COUNCIL OF TiiE CITY
OF ANAHEIM GPANTING VARIANCE NO. 2912.
WHEREAS, after a reauest for variance by Michael F. and
Mary N. Demeo, owners; Emerald Engineering, agent, was received,
a public hearing before the Planning Commission of the City of
Anaheim was held =son due and proper notice, a result of which
Variance No. 2912 was granted covering land situated in the State
of California, County of Orange, described as follows:
That portion of the Northwest quarter of the Southeast
quarter of Section 17, Township 4 South, Range 10 West,
in the Rancho Los Coyotes, in the City of Anaheim, as
the said Southeast auarter of said Section 17 is indi-
cated on a map filed in book 22, Page 25 of Records of
Surveys in the office of the County Recorder of said
County, more particularly described as follows:
Beginning at the Northwest corner of said Northwest
quarter of the Southeast quarter; thence South 0° 00'
05" East, along the West line of said Northwest quarter
165.51 feet; thence North 'A° 33' 00" Last, parallel
with the North line of said Northwest quarter, 142.83
feet; thence North 0° 27' 00" West, 165.50 feet to said
North line; thence South 89° 33' 00" West along said
North line 141.58 feet to the point of beginning.
WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action at a Public hearing
noticed and held as prescribed by law and, as a result thereof,
the City Council does hereby make the following findings:
1. That there are special circumstances applicable to the
property, including size, shape, topography, location or surround-
ings, which do not apply to other property under identical zoning
classification in the vicinity.
2. That, because of special circumstances shown in (1) above,
strict application of the zoning code deprives the property of privi-
leges enjoyed by other property under identical zoning classification
in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim, that a conditional zoning variance be, and the same
is hereby granted, Permitting establishment of two lots and construc-
tion of a single-family residence on the property hereinbefore de-
scribed with waivers of the following sections of the Anaheim Muni-
cipal Code:
SECTION 18.26.061.020 Minimum lot width. (70
feet required; 55 feet and
58 feet proposed)
SECTION 18.26.063.011 Minimum front-on garage
setback. (25 feet required;
8 feet proposed)
SECTION 18.26.065.010 Requirement that all lots
rear on an arterial highway.
(2 lots fronting on Orange
Avenue proposed)
That said variance be granted subject to the following conditions:
1. That this variance is granted subject to the completion
of Reclassification No. 76-77-38, now pending.
2. That subject Property shall be developed substantially
in accordance with plans and specifications on file with the City
of Anaheim marked Exhibit Nos. 1 and 2; provided, however, that an
operable automatic garage door opener shall be installed in the
proposed garage fronting onto Nutwood Street.
3. That Condition No. 1, above-mentioned, shall be cou1ied
with prior to the commencement of the activity authorized under
this resolution, or prior to the time that the building permit is
issued, or within a period of one year from date hereof, whichever
occurs first, or such further time as the Planning Commission and/or
City Council may grant.
4. That Condition No. 2, above-mentioned, shall be complied
with prior to final building and zoning inspections.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner(s),
their successors or assigns to comply with the Anaheim Municipal
Code and regulations and the conditions herein. Said variance is
granted for the term prescribed by the Anaheim Municipal Code un-
less otherwise specified herein.
