1977-226A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIH RESCINDING RESOLUTION NO. 73R-322
ADOPTING RULES, REGULATIONS OR SPECIFICATIONS
OF CONSTRUCTION, OPERATION AND MAINTENANCE OF
A CABLE TELEVISION SYST=.
WHEREAS, on July 3, 1973, the City Council adoptec
Ordinance 1:o. 3179 grantin9 a CATV System Franchise to Theta
Cable of California ("Theta"), which ordinance was subsequently
amended by Ordinance No. 3192; and
WHEREAS, following the acceptance of said Franchise by
Theta, the City Council adopted Resolution No. 73R-383 acloptinc_,
the rules, regulations or specifications of construction, opera-
tion and maintenance of a cable television system for the City of
Anaheim; and
WHEREAS, subsequent to the adoption of said Resolution
No. 73R-388, Theta failed to obtain a certificate of compliance
from the Federal Communications Commission as reauired by said
Franchise; and
W the City of Anaheiia has heretofore terminated
said Franchise in accordance with the orocedures set forth in
Section 27 of Ordinance No. 3179, as amended; and
WHEREAS, the rules, regulations or specifications here-
tofore adopted by Resolution No. 73R-382 are no longer applicable
or necessary.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Resolution Jo. 73R-333, adoptin the rules,
regulations or specifications of construction, operation and main-
tenance of a cable television system for the City of Anahei is
hereby rescinded.
