1977-680RESOLUTION NO. 77R-600 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 1750. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from FAMILY GROUP HOMES FOUNDATION, RICHARD KAUFMAN, owner, to permit a children's group home on the following described property: Lot 34 of Tract 4165 as per map recorded in book 150 pages 14 and 15 of Miscellaneous Maps, records of said county and state. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on the 12th day of September, 1977, notices of which said public hearing were duly given as reguired by law and the provi- sions of Title 18, Chapter 16.76 of the Anahein Municipal Code; and WEERLAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC77-193 denying Conditional Use Permit No. 1750; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in denying said Conditional Use Perlait and saict appeal was set for public hearing on the loth day of October, 1977, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 13, Chapter 13.76 of the Anaheir 7111 Code; and WEEREAS, at the time and place ffied for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and dia receive evidence and reoorts; and WHEREAS, the City Council, after receiving evidence both written and oral from the City Staff, Planning Commission and all persons desiring to be heard, does find that granting Conditional Use Permit No. 1750 would be detrimental to the peace, health, safety and general welfare of the citizens of Anaheim and would adversely affect adjoining land uses for the following reasons: 1. Children living in the subject residence have threatened and harassed the neighbors; 2. Children residing in such residence are not properly supervised; 3. Children residing in the residence have exhibited delin- quent and destructive conduct in the neighborhood; 4. As a result of the children living in the residence, the neighbors have been deprived of their property rights without due process; and 5. That the Family Group Home constitutes a public nuisance to the neighbors. WHEREAS, the City Council does further find, after care- ful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 1750 should be denied for the rea- sons hereinabove set forth. NOW, THEREFORE, DE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying Conditional Use Permit No. 1750 be, and the same is hereby, sustained, and that the request of Family Group Homes Foundation to permit a chiidren's group home be, and the same is hereby, denied.
