A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH THE STATE OF
CALIFORNIA, DEPARTMENT OF TRANSPORTATION, FOR
THE PERFORMANCE OF CERTAIN ENGINEERING, RIGHT
OF -WAY AND PLANNING SERVICES BY THE STATE IN
CONNECTION WITH THE CONSTRUCTION OF A HIGHWAY
OVERCROSSING AT CRESCENT AVENUE.
WHEREAS, the City of Anaheim is in need of
engineering, right -of -way and planning services in connec-
tion with its contemplated construction of a highway
overcrossing of the Santa Ana Freeway and The Atchison,
Topeka and Santa Fe Railroad at Crescent Avenue; and
WHEREAS, the State of California, Department of
Transportation is aualified to perform said engineering,
right -of -way and planning services; and
WHEREAS, the State of California, Department of
Transportation has heretofore submitted a proposal for the
performance of said services, the terms and conditions of
which proposal, including fees, are satisfactory to the
City of Anaheim; and
WHEREAS, an agreement has this day been submitted
to the City Council to be made and entered into between the
parties including the performance of said services on the
terms and conditions therein set forth for a fee not to
exceed $33,000.00; and
WHEREAS, the City Council finds that the terms
and conditions of said agreement are satisfactory and that
said agreement should be approved.
NOW, THEREFORE, BF IT RESOLVED by the City Council
of the City of Anaheim that the agreement submitted this
date to the City Council to be made and entered into by and
between the City and the State of California, Department of
Transportation, for the performance of said engineering,
right -of -way, and planning services in connection with the
contemplated construction of a highway overcrossing of the
Santa Ana Freeway and The Atchison, Topeka and the Santa Fe
Railroad at Crescent Avenue for a fee not to exceed $33,000.00
be, and the same is hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said
agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUT_I.ON is approved and signed by
me this 23rd day of August 1977.
