RESOLUTION NO. 77R-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN ENCROACHMENT PERMIT AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH-
MENT PERMIT WITH LEE 0. WEBB AND FLORENCE L.
WEBB AND JOSEPH G. NICOSIA (76 -20E).
WHEREAS, Lee 0. and Florence L. Webb, husband and
wife, and Joseph G. Nicosia, a married man, hereinafter
referred to as Licensees, are the owners of property in the
City of Anaheim over which the City owns a public utility
easement; and
WHEREAS, Licensees wish to encroach upon a portion
of said easement for the purpose of permitting a portion of an
existing sign overhang into City's dedicated right of way; and
WHEREAS, unless Licensees are allowed to encroach
upon the easement of the City, an extreme and undue hardship
will be caused to them; and
WHEREAS, the proposed encroachment for such installation
across a portion of the easement of City will not interfere with
the present use of the easement by the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of a license
agreement between the City of Anaheim and Lee 0. and Florence L.
Webb and Joseph G. Nicosia, be and the same are hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute said license
agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed, by me
this 2nd day of August 1977.
