A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIOVS
OF AN ENCROACHMENT PERMIT AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH-
MENT PERMIT WITH THE ORANGETHORPE IMPERIAL
ASSOCIATES. (76 -15E)
WHEREAS, Orangethorpe Imperial Associates, a
general partnership, hereinafter referred to as Licensee is
the owner of property in the City of Anaheim over which the
City owns a public utility easement; and
WHEREAS, Licensee wishes to encroach upon a
portion of said easement for the purpose of permitting a
private storm drain to encroach into a portion of dedicated
right of way; and
WHEREAS, unless Licensee is allowed to encroach
upon the easement of the City, an extreme and undue hardship
will be caused to it; and
WHEREAS, the proposed encroachment for such
installation across a portion of the easement of City will
not interfere with the present use of the easement by the
City.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of a
license agreement between the City of Anaheim and Orangethorpe
Imperial Associates, a general partnership, be and the same
are hereby approved.
BE ITT FURTHER RESOLVED that the Mayor and City
Clerk be, and they are hereby, authorized to execute said
license agreement for and on behalf of the City of Anaheim.
THE FOREGOING ZESOLUTIOJ is approved and signed by
