RESOLUTION NO. 77R- 223
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE EXECUTION OF AN
AGREEMENT WITH YATES INVESTMENTS, INC.,
TERMINATING THE AGREEMENT DATED NOVEMBER 6,
1973, FOR THE OPERATION OF A FOOD AND BEVERAGE
CONCESSION AT THE ANAHEIM HILLS MUNICIPAL GOLF
COURSE.
WHEREAS, the City of Anaheim and Yates Investments,
Inc., did heretofore enter into an agreement on November 6,
1973, for the operation of a food and beverage concession at
the Anaheim Hills Municipal Golf Course; and
WHEREAS, the execution of said agreement by the
City of Anaheim was authorized by City Council Resolution
No. 73R 533; and
WHEREAS, said agreement was for a term of five
years commencing on November 6, 1973, plus an option to
renew said agreement upon the same terms and conditions for
an additional term of five years; and
WHEREAS, the City of Anaheim and Yates Investments,
Inc., do mutually desire to terminate and cancel said agree-
ment at this time; and
WHEREAS, an agreement has been prepared terminating
said concession agreement, the terms and conditions of which
are satisfactory to the City of Anaheim; and
WHEREAS, the City Council finds that it is in the
best interests of the City of Anaheim to terminate said
concession agreement as requested by Yates Investments, Inc.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the Mayor and City Clerk be, and
they are hereby authorized and directed to execute said
agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
