A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING AND DIRECTING
THE MAYOR AND CITY CLERK TO EXECUTE AMEND
MENT.TO UTILITIES AGREEMENT NO. 7Ut -5028
WITH THE STATE OF CALIFORNIA (DEPARTMENT
OF TRANSPORTATION).
WHEREAS, the City of Anaheim and the State of California
(Department of Transportation) entered into Agreement No. 7Ut -5028
dated March 11, 1975, whereby the State agreed to pay certain costs
for relocation of power poles in connection with a construction
project on the Santa Ana Freeway between Chapman Avenue and
Orangewood Avenue at Walnut Street; and
WHEREAS, in the performance of said relocation work,
increased costs over and above those estimated at the time of
the execution of said Agreement were incurred because relocation
work was more difficult than originally anticipated and additional
guying was required; and
WHEREAS, the estimated cost of the work performed under
said Agreement was $1,025.00 and, by reason of the increased costs,
the actual cost to the State was $1,586.43; and
WHEREAS, by reason of the foregoing, it is now the
desire of the parties to amend said Utilities Agreement to
reflect said increased cost to the State; and
WHEREAS, an Amendment to Agreement has been prepared,
the terms and conditions of which are acceptable to the City
Council of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED that the terms and
conditions of said agreement are hereby approved and accepted.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized and directed to execute said
Agreement on behalf of the City Council of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
