1977-144RESOLUTION NO. 77R -144 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORDERING THE VACATION AND ABANDON MENT OF AN EASEMENT FOR ROAD PURPOSES. (Palm Street 75 -15A) WHEREAS, the City Council of the City of Anaheim has elected to proceed under the provisions of the Street Vacation Act of 1941 (Section 8300 et seq., Streets and Highways Code) in connection with requests for vacation and abandonment of public streets within the City of Anaheim; and WHEREAS, the City Council did, by resolution duly posted and published, give notice of its intention to abandon the follow- ing described public street; to wit, Palm Street (hereinafter Street) more specifically described as follows: That certain roadway, commonly known as Palm Street, located in the City of Anaheim, County of Orange, State of California, lying between Lots 27 and 28 of Anaheim Extension, as shown on a map made by Wm. Hamel in 1868 filed in the office of the County Re- corder of Los Angeles County, described as follows: Beginning at the southwest corner of said Lot 27, said corner being the centerline intersection of Ball Road and Paim Street; thence S 89 46' 30" W, 25.71 feet; thence N 15° 57' 00" W, 591.10 feet, more or less, to an intersection with a line paral- lel with and 53.00 feet easterly of the centerline of Harbor Blvd., a radial line bearing S 84° 00' 58" E passes through said point, said point of intersec- tion being a point in a curve concave northwesterly and having a radius of 1053 feet; thence Northeast- erly along said parallel line to an intersection with a line parallel along said curve through a central angle of 10° 21' 37" an arc distance of 190.40 feet to an intersection with a line parallel with and 30 feet easterly of the centerline of said Palm Street, a radial line bearing N 85° 37' 25" E passes through said point of intersection; thence S 15° 57' 00" E, 259.20 feet; thence N 74° 03' 00" E, 2.00 feet to an intersection with a line parallel with and 32.00 feet easterly of the centerline of said Paim Street; thence S 15° 57 00" E, 429.17 feet, more or less, to the be- ginning of a curve concave northeasterly and having a radius of 15 feet; thence Southeasterly and East- erly along said curve through a central angle of 75° 16' 30" an arc distance of 19.44 feet to an intersec- tion with a line parallel with and 53.00 feet north- erly of the centerline of Ball Road; thence S 0° 13' 30" E, 53.00 feet to the centerline of Ball Road; thence S 89° 46' 30" W, 33.24 feet to the point of beginning. -1- 75 -15A Excepting therefrom any portion thereof lying within Bali Road on the south 53.00 -foot wide half street. RESERVING UNTO the City of Anaheim, the Pacific Tele- Company, and the Southern California Gas Company a public utility easement over, under and across the easterly half of said Street as hereinabove described. WHEREAS, on the 1st day of March, 1977, a public hearing was held to allow interested persons to submit evidence concerning said proposed abandonment; and WHEREAS, the City Council of find from the evidence submitted to it sary for present or prospective public WHEREAS, the City Council has certain conditions must be met prior to ing and abandoning said Street. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does determine that said Street should be aban- doned and vacated subject to the following condition: That full street improvement be installed along the north side of Ball Road to close said Palm Street and that adequate pro- vision be made to handle and properly dispose of drainage which reaches Palm Street as such provision is required by the City En- gineer. BE IT FURTHER RESOLVED forth in the preceding paragraph eighty (180) days of the date of will make its order vacating and BE IT FURTHER RESOLVED that should said condition not be fulfilled within said one hundred eighty (180) days or such further time as the City Council may grant, then this Resolution shall ter- minate, and resort shall be had to a new and separate proceeding.
