A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM SUPERSEDING RESOLUTION NO. 76R -724
AND AUTHORIZING CERTAIN PERSONS TO REPRESENT
THE CITY OF ANAHEIM IN SMALL CLAIMS ACTIONS
AND AUTHORIZING SAID PERSONS TO COMPROMISE OR
SETTLE SMALL CLAIMS ACTIONS IF THE AMOUNT TO
BE PAID IS $750.00 OR LESS.
WHEREAS, the City Council of the City of Anaheim does
find and determine that it is necessary in the normal course of
City business to institute, prosecute, defend, and consummate
litigation involving small amounts, the jurisdiction of which
is vested in the Small Claims Court, being amounts of less than
$750.00; and
WHEREAS, it is deemed desirable by the City Council
of the City of Anaheim that certain City employees should be
authorized to act in the City's behalf in connection with Small
Claims actions.
WHEREAS, California Government Code, Section 935.4
provides for the authorization of an employee of the City to
perform duties connected with the compromise or settlement of
such claims on behalf of the City; and
WHEREAS, the handling of the compromise and settlement
of certain Small Claims actions against the City can be more
effectively pursued and concluded if the authorized City Small
Claims Representatives are authorized to perform such duties and
to sign agreements and other documents related to such compro-
mises or settlements on behalf of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the following named persons, to wit:
Donald Metzger
Ronald Howard
Judith Knight
Carlos A. Bragg
Cordelia Short
Commercial Office Supervisor
Assistant City Treasurer
Senior Credit Clerk
Utilities Credit Supervisor
License Collector
be, and the same are hereby, authorized to couutence, prosecute,
and consummate Small Claims litigation for, in behalf of, and in
the name of the City of Anaheim, and that they, and each of them,
are authorized to file Small Claims petitions, to appear at Small
Claims hearings, to represent the City, and to file satisfaction
of judgment in Small Claims actions, and to do any and all other
things necessary and convenient in the processing of Small Claims
actions.
BE IT FURTHER RESOLVED that the above named persons are
hereby authorized to compromise or settle Small Claims actions
for, in behalf of, and in the name of the City of Anaheim if the
amount to be paid is in the sum of $750.00 or less and they are
hereby authorized to execute and sign in behalf of the City of
Anaheim any and all agreements and other documents related
thereto.
AND BE IT FURTHER RESOLVED that Resolution No. 76R -724
be, and it is hereby, superseded by the, foregoing Resolution.
THE FOREGOING RESOLUTION is approved and signed by me
this 2211d day of February 1977.
