1977-097RESOLUTION NO. 77R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1636 AND SUPERSEDING RESOLUTION NO. 76R -556. WHEREAS, on the 14th day of September, City Council did by Resolution No. 76R -556 grant Use Permit No. 1636 subject to certain specified and -1- 1976, the Conditional conditions; WHEREAS, the applicant did request and receive a rehearing on said conditional use permit on February 15, 1977; and WHEREAS, at said rehearing new evidence, both oral and written, was received; and WHEREAS, the City Council desires to supersede Resolution No. 76R -556 and grant said conditional use permit subject to modified conditions. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 76R 556 be, and the same is hereby, superseded and that Conditonal Use Permit No. 1636 be, and the same is hereby, granted permitting an 80 -unit motel, subject to the following conditions: 1. That the owners of subject property shall pay to the City of Anaheim the sum of sixty (60) cents per front foot along Katella Avenue for tree planting purposes. 2. That the owners of subject property shall install street trees in the public parkway along Easy Way in accordance with City specifications and subject to the approval of the Superintendent of Parkway Maintenance. 3. That the owners of subject property shall pay to the City of Anaheim the sum of two dollars ($2.00) per front foot along Katella Avenue and Easy Way for street lighting purposes. 4. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works, as stipulated to by the petitioner. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That any parking area lighting proposed shall be down lighted and directed away from the northerly property line to protect the adjacent residential uses. 7. That subject property shall be developed sub stantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1 (Revision 1), and 2 through 4; provided, however, that kitchen efficiency units with a maximum of 8 -cubic foot refrigerators and single compartment sinks may be installed, except that the manager's unit will be allowed to have full kitchen facilities. 8. That Conditions Nos. 1 and 3, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission and /or City Council may grant. 9. That Conditions Nos. 2, 4, 6 and 7, above mentioned, shall be complied with prior to final building and zoning inspections. 10. That the maximum length of tenancy in the motel units shall not exceed two (2) weeks, as stipulated to by the petitioner. 11. That, if any tenant or tenants are allowed to remain over thirty (30) consecutive days, the owner hereby agrees and stipulates, and it is a material part of the grant of this permit, that existing kitchenette facilities shall be immediately removed so as to reduce the number of units with kitchenettes to not more than 25% of the total number of motel units. It is further agreed and stipulated by the owner that the City of Anaheim shall have the right, in addition to any other right or remedy otherwise available to the City, to enforce the provisions of this condition by a civil court action and that the court may award reasonable attorney's fees to the prevailing party in such action. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
