A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING AN EASEMENT DEED FOR
STREET, HIGHWAY, SLOPE AND DRAINAGE PURPOSES.
(Southern Pacific Mile Post BM- 512.75 -C(N)
WHEREAS, an easement deed for street, highway,
slope and drainage purposes has been presented to the City
of Anaheim; and
WHEREAS, said deed having been determined to be correct
in both form and substance, the City Council finds it is in the
best interest of the City of Anaheim to accept said deed; and
WHEREAS, said deed contains conditions which obligate
the City of Anaheim to reimburse Southern Pacific Transportation
Company for certain materials and labor to be provided and perform-
ed by Southern Pacific on behalf of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Anaheim does hereby resolve to accept said deed.
BE IT FURTHER RESOLVED that the Finance Director be, and
he is hereby authorized and directed to reimburse Southern Pacific
Transportation Company upon presentation of bills therefor
pursuant to the terms of said Agreement.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby authorized and directed to transmit said easement deed
and a certified copy of this resolution to Southern Pacific Trans-
portation Company for execution by Southern Pacific.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause said deed to be
recorded in the office of the County Recorder upon receipt of said
executed deed from Southern Pacific Transportation Company.
THE FOREGOING RESOLUTION is approved and signed by me
this 1st day of February 1977.
