A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING THE TERMS AND CONDITIONS OF AN
AMENDMENT TO AGREEMENT WITH TEXACO ANAHEIM HILLS,
INC., IN CONNECTION WITH REIMBURSEMENT OF COSTS
FOR SPECIAL WATER FACILITIES, AND AUTHORIZING AND
DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE SAID
AMENDMENT TO AGREEMENT ON BEHALF OF THE CITY OF
ANAHEIM.
WHEREAS, on the 7th day of December, 1976, the City
of Anaheim entered into an Agreement providing, among other
things, that Texaco Anaheim Hilis, Inc., pay its share of prior
advances for special facilities to serve Tract 9465 pursuant to
Rule No. 15 of the City's Water Rates, Rules and Regulations and
that the City would attempt to collect from the ultimate users
of said special facilities, the fees necessary to reimburse
Texaco Anaheim Hills, Inc., towards the cost of such facilities;
and
WHEREAS, it is the desire of the City of Anaheim and
Texaco Anaheim Hilis, Inc., to amend said Agreement to provide
that the date for payment by Texaco Anaheim Hills, Inc., be
extended due to the failure of escrow to close on a certain date
in connection with the proposed sale of said Tract by Texaco
Anaheim Hills, Inc.; and
WHEREAS, an Amendment to said Agreement has been pre-
pared to provide for such change of payment date; and
WHEREAS, the terms and conditions of said Amendment to
Agreement are acceptable to the City Council of the City of
Anaheim.
NOW, THEREFORE, BE IT RESOLVED that the terms and
conditions of said Amendment to Agreement are hereby approved
and accepted.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized and directed to execute said
Amendment to Agreement on behalf of the City of Anaheim.
