ESOLUTION NO. 77R
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING AN EASEMENT DEED; APPROV-
ING THE TERMS AND CONDITIONS OF AN AGREEMENT
WITH CLASSIC DEVELOPMENT:': CORPORATION IN CON-
NECTION WITH. THE CONSTRUCTION OF A PUBLIC
STREET AND AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE SAID AGREEMENT ON BEHALF OF
THE CITY OF ANAHEIM.
WHEREAS, Classic Development Corporation "Classic is
the owner of certain real property "Land located in the City of
Anaheim; and
WHEREAS, the City of Anaheim "City in order to pro-
vide adequate vehicular circulation to adjacent areas, wishes to
construct a public street across Land; and
WHEREAS, Classic is agreeable to dedicating to City an
easement for road and public utility purposes across Land; and
WHEREAS, Classic is currently in the process of construc-
ting street improvements in a subdivision adjacent to Land; and
WHEREAS, Classic is agreeable to including the construc-
tion of street improvements across Land with the Classic subdivision
improvement; and
WHEREAS, it would be in the best public interest for
Classic to include said street improvements with said subdivision
improvements; and
WHEREAS, an agreement has been prepared, the terms and
conditions of which are satisfactory to the City of Anaheim,
whereby Classic will construct said public street.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that an Easement Deed for road and public
utility purposes across property owned by Classic Development
Corporation be, and the same is hereby, accepted.
BE IT FURTHER RESOLVED that the terms and conditions of
an agreement between the City of Anaheim and Classic Development
Corporation in connection with the construction of a public street
be, and the same is hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are
hereby authorized to execute said agreement on behalf of the City
of Anaheim.
