1977-006WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 76 -77 -29 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission, the City Council did fix the 4th day of January 19 77, and continued to the -day of 19 as the time, and the C thy Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportun- ity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. ATTY -18 -C (Page 1 of 2 pages) RESOLUTION NO. 77-6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. -1- 76 -77 -29 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of the Northwest quarter of the Northeast quarter of Section 24, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as per map recorded in Book 51, page 10, Miscellaneous Haps, records of Orange CoUnty, described as follows: Beginning at the northwest corner of said Northwest quarter, said corner being the point of intersection of the centerline o Ball Road with the centerline of Sunkist Street, as shown on a map filed in Book 83, page 31, Record of Surveys, in the officeof the County Recorder of said Orange County; thence S 1° 21" W along the westerly line of said Northwest quarter being coincident with said centerline of Sunkist Street, a distance of 95.00 feet to the true point of beginning; thence S 89° 55' 39" E, 57.00 feet; thence N A40 04' 05" E, 54.94 feet to a point in a line that is parallel with and distant southerly 55.00 feet, measured at right angles from the northerly line of said l'orthwest quarter, said northerly line being coincident with said cen- terline of Bali Road; thence S 29° 02 32" TT parallel with said centerline of Ball Road, 65.00 feet; thence S 79° 57' 09" E, 32.77 feet to a point in a line that is parallel with and distant easterly 191.83 feet, measured along said centerline of Ball Road, from said center- line of Sunkist Street; thence S 1° 04.' 21" W parallel with said Sunkist Street 142.65 feet to a point. in a line that is parallel with distant southerly 202.53 feet, measured along said centerline of Sunkist Street, from said centerline of Ball Road; thence Ti 89° 02' 32" W parallel with said centerline of Ball Road, a distance of 191.83 feet to a point in said centerline of Sunkist Street; thence N .1° 04' 21" E along said centerline of Sunkist Street 107.83 feet to the true point of beginning. That the owner (s) of subject property shall deed to the City of Anaheim a stri of land 45 feet in width from the center- line of the street along Sunkist Street and 53 feet in width from the centerline of the street along Ball Road or street widening purTDoses. 2. That all engineering =Juirenents of the City of Anaheim along Ball Road and Sunkist Street including preparation of imrove- ment plans and installation of all j=provements such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other appurtenent work, shall be complied with as reciuired Jai the City Engineer and in accordance with standard plans and speci- fications on file in the Office of the City Engineer; that street lighting facilities along Ball Road and Sunkist Street shall be installed as required by the Director of Public Utilities, and in accordance with standard specifications on file in the Office of the Director of Public Utilities; or that a bond, certificate of deposit, letter of credit, or cash, in an al:lount and form satis- factory to tie City of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned reguirements. s. That the owner(s) of subject property shall pay to the City of Anaheim the sum of si::ty (50) cents per front foot along Ball .?.oad and Sunkist Street for tree Planting purposes. 4. That subject proDerty shall be cerw- bv nderground utilities. 3. That drainage o subject -roperty shall be disposed of in a manner satisfactory to the City Engineer. 6 That the owner of subject property shall ay to the City of Anaheim the appropriate park and recreation in-lieu fees as de- termined to be appropriate by the City Council, saiJ fees to be aid at the time the building permit is issued. 7. That these reclassification proceedings are granted sub- ject to completion of anneNation of sublect property to the City of Anaheim. Q u. That development of subject property shall be in accord- ance with Council Policy No. 542 pertaining to sound attenuation for residential uses. 9. In the event subject property is to be divided for the purpose of sale, lease, or financing, a parcel map, to record the approved division of subject property, be submitted to and aproved by the City of Anaheim and then be recorded in the Office of the Orange County Recorder. 10. Prior to the introduction of an ordinance rezoning sub- ject property, Condition No. 7, above-mentioned, shall be compacted. The provisions or rights ranted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such fur- ther time as the City Council may grant. —3 n 11.
