1977-004WHEREAS, Crow /Pacific Development Corporation has
applied to the City for water facilities to serve Tract
9313; and
WHEREAS, the City is unable to furnish water to
said Tract in the absence of special facilities as defined
pursuant to Rule No. 15 of the Water Rules of the City of
Anaheim; and
WHEREAS, Crow /Pacific Development Corporation is
willing to pay the City its share of prior advances pursuant
to said Rule No. 15 and the City is willing to attempt to
collect from the ultimate users of said special facilities,
and /or persons within the Special Facilities District No. 1,
the fees necessary to reimburse Crow /Pacific Development
Corporation towards the cost of said special facilities; and
WHEREAS, an agreement has been prepared, the terms
and conditions of which are satisfactory to and in the best
interests of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of an
agreement between the City of Anaheim and Crow /Pacific
Development Corporation in connection with the reimbursement
of costs for special water facilities be, and the same are
hereby, approved.
