1976-800RESOLUTION NO. 76R-800 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING, IN PART, VARIANCE NO. 2858. WHEREAS, after a request for variance by Charles C. Lucas, owner; Lynn E. Thomsen, agent, was received a public hear- ing before the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 2858 was granted, in part, covering the following described property: That portion of Section 9, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, described as follows: Beginning at a point in the Northerly line of Lot 4, as shown on a Licensed Surveyer's Map of a portion of Section 9, made for F.W. Fleischmann and filed in book 1, at page 56, of Record of Surveys, in the office of the County Recorder of said Orange County, 289.82 feet Westerly from the center line of nest Street, as shown on said map; running thence Southerly, parallel with the Easterly line of the West one-half of the Northwest quarter of said Section, 1176.4 feet to the Southerly line of said Lot 4; thence Westerly along said Southerly line, 464, feet to the true point of beginning of the boundary of the land herein described; thence Northerly, along a line parallel with the Easterly line of the West one-half of the Northwest quarter of said Section 9, 426 feet; thence Westerly para- llel with the Southerlv line of said Lot 4, 110 feet to the Northeast corner of the land conveyed to Vernon C. Starr and wife, by deed recorded July 31, 1946, in book 1423, at page 472 of Official Records, in the office of the County Recorder of said Orange County; thence Southerly along the Easterly line of said land conveyed to Starr, 426 feet to the Southeast corner thereof; thence East- erly along the Southerly line of said Lot 4, a distance of 110 feet to the true point of beginning. Together with the appurtenant interest in the well, pumping plant, rights of way and pipe line used in furnishing water to the above described land from the water well now located on a part of Lot 4 in Section 9, in Township 4 South, Range 10 West, San Bernardino Base and 14eridian, as per map thereof recorded in book 1, at page 56, of Record of Sur- veys, in the office of the County Recorder of said Orange County, as conveyed in a deed dated July 13, 1927, from Citizens Trust and Savings Bank, a cor- poration, to S.M. Whisnant, and wife, recorded August 9, 1927 in book 77, at page 34 of Official Records, in the office of the County Recorder of said Orange County. WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: -1- 1. That there are special property, including size, shape, ings, which do not apply to other classification in the vicinity. circumstances applicable to the topography, location or surround - property under identical zoning 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classification in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that a conditional zoning variance be, and the same is hereby, granted permitting the construction of four duplexes on the property hereinbefore described with waiver of the following section of the Anaheim Municipal Code: SECTION 18.34.065.OT1 - Minimum distance between buildings. (22 feet required; 10 feet proposed) That said variance be granted subject to the following conditions: 1. That this variance is granted subject to the completion of Reclassification No. 76-77-19. 2. That the subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 (Revision 1) and 2. 3. That the single-family homes approved as part of such development shall be built either prior to or conjunctively with the proposed multiple -family structures. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit forgood cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term pre- scribed by the Anaheim 24unicipal Code unless otherwise specified herein.
