1976-799RESOLUTION NO. 76R-799 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 76-77719 to consider an amendment to Title 18 of the Anaheim 'Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopte��bP e City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 12th day of December , 19 76 , and continued to the - - - day of _ _ - , Imo, as the time, and the City CounciTTTambers in the City Hall of the City of Anaheim as the place for a public hearinq upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereunon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findinqs and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Cc,c-. should be adopted and that tine property hereinafter describes s?,.ould be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED the City of Anaheim that Title 18 of the be, and the same is hereby, amended and described property, situated in the City Orange, State of California, to wit: -1- ATTY—I8-C (Page 1 of 1 page) by the City Council of Anaheim Munic-nal Code that the following of Anaheim, County of 76-77-19 That portion of Section 9, in Township 4 South, Range 10 West, San Bernardino Base and D-leridian, described as follows: Beginning at a point in the Northerly line of Lot 4, as shown on a Licensed Surveyer"s Map of a portion of Section 9, made for F.W. Fleischmann and filed in book 1, at page 56, of Record of Surveys, in the office of the County Recorder of said Orange County, 289.82 feet Westerly from the center line of West Street, as shown on said map; running thence Southerly, parallel with the East- erly line of the West one-half of the Northwest quarter of said Section, 1176.4 feet to the South- erly line of said Lot 4; thence Westerly along said Southerly line, 464, feet to the true point of beginning of the boundary of the land herein described; thence Northerly, along a line parallel with the Easterly line of the West one-half of the Northwest quarter of said Section 9, 426 feet; thence Westerly parallel with the Southerly line of said Lot 4, 110 feet to the Northeast corner of the land conveyed to Vernon C. Starr and wife, by deed recorded July 31, 1946, in book 1423, at page 472 of Official Records, in the office of the County Recorder of said Orange County; thence Southerly along the Easterly line of said land conveyed to Starr, 426 feet to the Southeast cor- ner thereof; thence Easterly along the Southerly line of said Lot 4, a distance of 110 feet to the true point of beginning. Together with the appurtenant interest in the well, pumping plant, rights of way and pipe line used in furnishing water to the above described land from the water well now located on a part of Lot 4 in Section 9, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, as per map thereof recorded in book 1, at page 56, of Record of Sur- veys, in the office of the County Recorder of said Orange County, as conveyed in a deed dated July 13, 1927, from Citizens Trust and Savings Bank, a cor- poration, to S.M. Whisnant, and wife, recorded August 9, 1927 in book 77, at page 34 of Official Records, in the office of the County Recorder of said Orange County. be excluded from "RS -10,000" RESIDENTIAL, SINGLE-FAMILY ZONE and incorporated in "RM -1200" RESIDEINTIAL, MULTIPLE-FP24ILY ZONE, sub- ject to the following conditions: 1. That this reclassification shall apply only to the north- erly approximately 0.68 acre portion of subject property initially proposed for rezoning, said portion being approximately 305 feet deep and 110 feet wide and abutting the proposed extension of Lido Place. 2. That the owner(s) of subject property shall deed to the City of Anaheim sufficient property from the construction of a stand- ard symmetrical cul-de-sac at the east end of Lido Place. -2- 3. That all engineering requirements of the City of Anaheim, along north Street and Lido Place (standard symmetrical cul-de-sac), including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; that street lighting facilities along North Street and Lido Place shall be installed as required by the Director of Public Utilities, and in accordance with standard specifications on file in the Office of the Director of Public Utilities; and/or that a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the installation of the above-mentioned requirements. 4. That the owner(s) of the subject property shall pay to the City of Anaheim the sum of sixty (60) cents per front foot along North Street and Lido Place for tree planting purposes. 5. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Pub- lic Works. 6. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department, prior to commencement of structural framing. 7. That the subject property shall be served by underground utilities. 8. That a six-foot high masonry wall shall be constructed along the east, north, and west property lines adjacent to the single-family zoned property and in accordance with Code require- ments. 9. That drainage of the subject property shall be disposed of in a manner satisfactory to the City Engineer. 10. In the event that the subject property is to be divided for the purpose of sale, lease, or financing, a parcel map to re- cord the approved division of subject property shall be submitted to and approved by the City of Anaheim and then be recorded in the Office of the Orange County Recorder. 11. That the owner(s) of the subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees, as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 12. That the single-family homes approved as part of such development shall be built either prior to or conjunctively with the proposed multiple -family structures. 13. Prior to the introduction of an ordinance rezoning sub- ject property, Condition otos. 2, 3, 4 and 10, above-mentioned, shall be completed. The provisions or rights granted by the resolution shall become null and void by action of the City Council unless said conditions are complied with within one (1) year from the date hereof, or such further time as the City Council may grant. -3- 14. That Condition Nos. 5, 7, 8, 9 and 12, above-mentioned, shall be complied with prior to final building and zoning inspec- tions. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
