A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEII4 APPROVI 4G THE TER 4S OF AN AGREEMENT
BETWEEN THE CITY OF ANAHEIM AND TEXACO ANAHEIM
HILLS, INC. RE REIAsBURSEMENT OF COSTS FOR SPEC-
IAL WATER FACILITIES, AND AUTHORIZING THE 14AYOR
AND CITY CLERK TO EXECUTE SAID AGREEMENT.
WHEREAS, Texaco Anaheim Hills, Inc. has applied to the
City for water facilities to serve Tract 9465; and
WHEREAS, the City is unable to furnish water to said
Tract in the absence of special facilities as defined pursuant to
Rule No. 15 of the Water Rules of the City of Anaheim; and
WHEREAS, Texaco Anaheim Hills, Inc. is willing to pay
the City its share of prior advances pursuant -co said Rule No. 15
and the City is willing to attempt to collect from the ultimate
users of said special facilities, and/or persons within the Spec-
ial Facilities District No. 1, the fees necessary to reimburse
Texaco Anaheim Hills, Inc. towards the cost of said special
facilities; and
WHEREAS, an agreement has been prepared, the terms and
conditions of which are satisfactory to and in the best interests
of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of an agreement
between the City of Anaheim and Texaco Anaheim Hills, Inc. in
connection with the reimbursement of costs for special water faci-
lities be, and the same are hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are
hereby authorized to execute said agreement on behalf of the City
of Anaheim.
