A RESOLUTION OF THE CIT" COU1CIL OF THE CITY
OF ANAHEIM APPROVING THE TERNS OF AN AGREEMENT
BETWEEN THE CITY OF ANAHEIM AND ROBERT P.
'HARMINGTON COMPANY IAT CONNECTION WITH REIMBURSE-
.4ENT OF COSTS FOR SPECIAL WATER FACILITIES, AND
AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
SAID AGREEMENT.
WHEREAS, Robert P. Warmington Company has applied
to the City of Anaheim for water facilities to serve Tracts
8463 and 8466; and
WHEREAS, the City is unable to furnish water to
said Tracts in the absence of special facilities as defined
pursuant to Rule No. 15 of the Water Rules of the City of
Anaheim; and
HEREAS, Robert P. Warmington Company is villin -
to pay the City its share of prior advances pursuant to said
Rule No. 15 and the City is willing to attempt to collect
from the ultimate users of said special facilities, and/or
persons within the Special Facilities District No. 1, the
fees necessary to reimburse Robert P. Warmington Company
towards the cost of said special facilities; and
WHEREAS, an a. reement has been prepared, the terms
and conditions of which are satisfactory to and. in the best
interests of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of an
agreement between the City of Anaheim and Robert P. Warminm-
ton Company in connection with the reimbursement of costs
for special water facilities be, and the same are hereby,
approved.
BE IT FURTHER RESOLVED that the Mayor and City
Clerk are hereby authorized to execute said agreement on
behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 7th day of December 1976.
