1976-761RESOLUTION NO. 76R-761 A RESOLUTION OF THE CITY COUNCIL 07 THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM `'!UNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CIiANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 76-77-20 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evi:aence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 30th day of November , 1976 , and continued to the day of , 19 , as the time, and the City Council Clambers innthi City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municinal Cc=,_e should be adopted and that the property hereinafter describeu sloul.d be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter_ set forth. - NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim "funic -.pal Code be, and the same is hereby, amended and that the following - described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 76-77-20 Those pc .:ions of Blocks 24 and 25 L._ the Golden State Tract, in the City of Anaheim, County of Orange, State of California, as per map recorded in book 4, pages 66 and 67 of Miscellaneous Maps, records of said Orange County, described as a whole as follows: Beginning at the most Easterly corner of Parcel 1 as shown on a map filed in book 73, page 10 of Par- cel Maps, records of said County, said corner being a point on the Southeasterly line of the land de- scribed in Parcel 1 in the deed to Holly Wade Davidson, recorded March 18, 1955, in book 3000, page 254, Official Records; thence Northeasterly 295.35 feet along said southeasterly line and the prolongation thereof to the most Easterly corner of the land described in -the deed to Holly Wade Davidson, recorded April 4, 1968 in book 8563, page 67, Official Records; thence along the boundary of said land North 300 13' 21" Nest 177.30 feet and South 740 32' 28" West 45.75 feet to a point in the Southerly line of the land described in the deed to the State of California, recorded June 4, 1963 in book 6573, page 167, Official Records; thence along said Southerly line South 740 32' 28" West 46.49 feet to the beginning of a tangent curve, concave Northerly, having a radius of 471.99 feet; thence Westerly along said curve and along said Southerly line 227.54 feet through a central angle of 271 37' 16" to the Northeasterly corner of said Parcel 1 of Parcel Map 73-10; thence South 28° 40' 23" East 297.01 feet, along the Northeasterly boundary of said Parcel 1, to the Point of Beginning. be excluded from "RS -A-43,000" RESIDENTIAL/AGRICULTURAL ZONE and incorporated in "R24-1200" RESIDENTIAL, MULTIPLE FAMILY ZONE, sub- ject to the following conditions: 1. That a soils engineering report attesting to the suit- ability of the site for the proposed residential development shall be submitted to the Building and Engineering Divisions for approval prior to the issuance of a building permit, and a copy of said re- port shall be filed with the Planning Department. 2. That all engineering requirements of the City of Anaheim along Frontera Street and Glassell Street, including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; that street lighting facilities along Frontera Street and Glassell Street shall be installed as required by the Director of Public Utilities, and in accordance with standard plans and specifications on file in the Office of the Director of Public Utilities; and/or that a bond, -2- certificate o- deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above-mentioned require- ments. 3. That the owner(s) of the subject property shall pay to the City of Anaheim the sum of sixty (60) cents per front foot along Frontera Street and Glassell Street for tree planting pur- poses. 4. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That the subject property shall be served by underground utilities. 7. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 8. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees, as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 9. That appropriate water assessment fees, as determined by the Director of Public Utilities, shall be paid to the CiIL-y of Anaheim prior to the issuance of a building permit. 10. That ordinances reclassifying the property may be adopted as each parcel is ready to comply with conditions pertaining to such parcel; provided, however, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels approved by the City Council for a lot split. 11. Prior to the introduction of an ordinance rezoning sub- ject property, Condition :dos. 2 and 3, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one (1) year from the date hereof, or such further time as the City Council may grant. 12. That Condition Nos. 4, 6 and 7, above-mentioned, shall be complied with prior to final building and zoning inspections. B.E. IT FUPPLHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper. -3- THE FOREGOING RESOLUTION is approved and signed by me this -1 day %a ?T JV - "b I- 1976.
