1976-707RESOLUTION NO. 76R-707 A RESOLUTIO14 OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2835. WHEREAS, after a request for variance by CITY OF ANAHEIM was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2835 was granted covering the following described property: All that certain real property in the City of Anaheim, County of Orange, State of California described as follows: Beginning at the intersection of the Southerly line of Chartres Street 52.50 feet wide with the Easterly line of Claudina Street 53.00 feet wide; thence North 740 27' 41" East, along the Southerly line of said Chartres Street, 293.00 feet to the Easterly line of Emily Street 53.00 feet wide; thence South 150 30' 00" East, along the Easterly line of Emily Street, 210.00 feet to the Northerly line of an alley 15.00 feet wide; thence South 740 27' 4111 West, 53.00 feet to the Westerly line of Emily Street; thence South 150 30' 00" East, along the Westerly line of Emily Street, 21.31 feet to a point 25.00 feet Northerly of the Southerly line of an alley 8.81 feet wide; thence South 740 19' 48" West, 240.00 feet to the Easterly line of Claudina Street at a point 25.00 feet Northerly of the Southerly line of an alley 9.36 feet wide; thence North 150 30' 00" West along the Easterly line of Claudina Street, 231-36 feet to the Souther- ly line of Chartres Street at said point of beginning. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning, classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council --- of the City of Anaheim, that a conditional zoning variance be, and the same is hereby granted, permitting the construc- tion of a 100 -unit apartment complex for the elderly on the -1- property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: SECTION 18.34.061.010 - Minimum building site area per dwelling unit. (1200 sq. ft. required; 668 sq. ft. proposed) SECTION 18.34.062.011 - Maximum building height. (2 stories permitted; 3 stories proposed) SECTION 18.34.062.030 - Minimum floor area. (700 sq. ft. required; 576 sq. ft. proposed) SECTION 18.34.063.012 - Minimum structural setback. (15 ft. required; 7-10 ft. proposed) SECTION 18.34.063.032 - Minimum recreational - leisure area. (200 sq. ft. per dwelling unit required; 100 sq. ft. proposed) SECTION 18.34.064.070 - Maximum wall height. (42 inches permitted in front setback; 6 ft. proposed) SECTION 18.34.066.012 - Minimum number of covered parking spaces. (100 spaces required; none proposed) SECTION 18.34.066.0121- Minimum off-street parking. (1.50 spaces required; 23 spaces proposed) That said variance be granted subject to the following conditions: 1. That this Variance is granted subject to the completion of Reclassification No. 76-77-17, now pending. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 5. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said CITY OF ANAHEIM, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise speci- fied herein.
