A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE EXECUTION OF AN
AMENDMENT TO UTILITIES AGREEMENT NO. 7Ut-4838
WITH THE STATE OF CALIFORNIA.
WHEREAS, the City of Anaheim and the State of
California have entered into that certain Utilities
Agreement No. 7Ut-4838 dated September 25, 1973, which
agreement sets forth the terms and conditions pursuant to
which the City has relocated its water facilities to
accommodate the construction of the Santa Ana Freeway
widening at Brookhurst (0.2 mile Freeway widening at
Brookhurst (0.2 mile south to 0.2 mile north of Brookhurst
Avenue) ; and
WHEREAS, subsequent to the execution of the
original agreement, it has been determined that it is
necessary to amend said agreement since, in the performance
of said relocation work, increased costs over and above
those estimated at the time of the execution of said Agree-
ment were incurred because it became necessary to alter
nine water services; and
WHEREAS, by reason of the foregoing, it is now
the desire of the parties to amend said Utilities Agreement;
and
WHEREAS, the State of California has submitted to
the City, Amendment to Utilities.Agreement No. 7Ut-4838; and
WHEREAS, said Amendment to Agreement has been
reviewed by all City departments involved and has been found
to be satisfactory in all respects; and
WHEREAS, the City Council finds that it is in
the best interest of the City of Anaheim to enter into
said Amendment to Utilities Agreement No. 7Ut-4838 with the
State of California.
NOW, THEREFORE, BE IT RESOLVED by the City
Council of the City of Anaheim that the Mayor and the
City Clerk be, and they are hereby, authorized and
directed to execute said Amendment to Agreement for and on
behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed
by me this 2nd day of November, 1976.
